Hi,

It is in relation to the Parking Charge Notice received from UKPC. The driver went to Homebase and bought goods which needed to be loaded via rear side door. The car already had goods bought from another store Wickes (the driver has receipt) which meant only way to load the items bought were from side passenger door. They parking bays being too narrow required the car to be moved to load and then the driver saw one item was incorrect and got back into the store to change and received the PCN.

The driver explained this to the store manager who also agreed and emailed UKPC to cancel the PCN but UKPC refused to cancel.

This seems bit unreasonable from UKPC. The driver has been shopping over 5 years and received no PCN only to obtain when it appeared a genuine reason. Any grounds to appeal though it seems unlikely it will be allowed. Below link to pictures and PCN.

Another visit to the store may be in order - whilst the manager seems to have been fairly helpful, one likely reason UKPC didn't listen to them may be because Homebase are not the ones who hired them. As this appears to be a retail park, it's likely that the owners of the retail park, or their managing agents, hired UKPC. See if the store is able to put you in touch with them, or alternatively try to find their details and make contact.

On the face of it, it would seem that the driver has breached the terms of the contract, so as far as UKPC are concerned (and probably POPLA), the charge has been 'correctly issued'. Unless you can get the retail park to intervene this could be a hard one to beat.

Not much assistance from the store and head office. Neither are ready to help the driver to request cancellation via land owner or managing agent but suggesting to pursue other legal channels.

So they'll have a timed receipt for the replacement item.

Also, where were the items put while the car was being moved? Unless they were left outside the car then they'd been loaded while the car was correctly parked which begs the question why move the car at all?

OP, the photos are damning because they show that when taken the car could have been parked wholly within a bay with empty bays on either side.

As others have posted, Plan A is your best option, but even with this you'll need to find a compelling argument which IMO includes the length of time away from the vehicle and issues regarding size.
