Eurocarparks PCN - no valid pay & display, Wish St Rye

Driver entered car park 16/2/24 10:45.  Parked and paid for 2 hrs at machine, entering reg no as required and displaying the ticket on windscreen.  Left the car park at 12:48, within the time paid for. 

Received a PCN roughly a week later dated 21/2  stating no valid pay & display/permit was purchased.  Ticket had been thrown away but luckily had paid by credit card.

Made an online appeal 29/2 stating payment had been made and giving a screen shot of the credit card transaction ( showing payee, date & amt pd).  Time of transaction did not show online but this info was obtained from the credit card company (10:49) along with a transaction reference and included in the appeal. Did not keep a screen shot of this appeal.

Receipt of the appeal was acknowledged by email 29/2 from no response email address.

No further correspondence was received in relation to this appeal, assumed all had been settled.

Final notification letter received 27/4. No contact details provided by Eurocarparks other than appeals address to discuss the matter.  Letter states 'if your appeal is unsuccessful you will be advised in writing ( within 28 days)'.  As no response had been received to the initial appeal assumed this was an error and was ignored

Debt recovery letter received 31/5 giving a deadline to pay of 14/6 if to avoid 'intent not to pay'

Unable to appeal to POPLA as no rejection of appeal received so no reference number. Checked junk folder, not there.

Should a further appeal/complaint be made to Eurocarparks to ask why no response to the appeal?  Should a subject access request be submitted to obtain details of registration numbers recorded at the relevant time?

Or should it just be ignored as proof of a payment can be provided if taken to court?

Don't have exact wording but stated payment had been made and attached images of the credit card statement and the credit card itself.  In the narrative gave the time of transaction & ref as provided by the credit card company and asked for records to be rechecked. Didn't request details of registration numbers entered at that time. Did not state who was driving, probably used I & we in narrative.

Did not state who was driving, probably used I & we in narrative.
“I drove...” and “I parked...” are very different from “We drove...” and “We parked...”. So, was “I” used or “we” used when it came to anything about who drove or parked?

Should a subject access request be submitted to obtain details - yes, absolutely. You keep referring to a response to your 'appeal', well a SAR* would nail this once and for all as regards what was sent, when and how.

And post the last letter you received because we need to see where you are in this legal process.

IMO, there is no useful purpose served in simply repeating what you've not received.

*-as regards formal notices is 'you' actually you or is it a hire company or employer which has simply passed their notice(s) to you?
Are 'you' and individual or a company?
These are important matters as regards a Subject Access Request.

Thanks for your responses.

This post relates to a PCN sent directly to an individual.
All of the documents received to date have been attached, the most recent one being from Debt Recovery Plus

I cannot say for certain whether "I" or "we" was used when appealing the original pcn but think probably "we"as there was more than 1 person present.

Then submit a SAR.

The latest letter is part of their huff and puff and is extra procedural. The next legal step is a Letter of Claim.
