UKCPS Parking Charge - Out of marked bay - Leeds City Station

Hello,

I received a 'Notice to Keeper (Postal - Non PoFA)' dated 20th Oct with the reason for issue as 'Out of marked bay'.

I have seen a couple of topics for the same location but for 'no stopping' so I would like to get some advice on whether it'd be the same approach.


The context... is that I was dropping off some work colleagues, had pulled into the drop off point area but pulled slightly forward to let the car behind me out so had slightly encroached into the side of a disabled parking bay that was adjacent to the drop off point (all for less than 2 minutes whilst they got their bags out of the boot, the engine was running and in no way was I 'parked' in the sense of leaving the car. Had someone have needed to get into the bay, I would have been able to move out of their way instantly.


I had initially appealed this directly to UKCPS to that effect (before being aware of this website) which I was notified yesterday that this was unsuccessful for the following reason:

Individual parking bays are provided for the use of motorists that comply with the terms and conditions ensuring
that full allocation of the site is available for vehicles parking and minimises any potential inconvenience or
hazards to other motorists. Motorists who park their vehicle in such a manner in disregard of the terms and
conditions will receive a parking charge. On the evidence that has been provided it has been confirmed that your
vehicle was parked outside the confines of a marked bay at the time of event. It is the driver's responsibility to
ensure that their vehicle is parked correctly in compliance with the terms and conditions. The circumstances
outlined in your appeal do not negate you from the terms and conditions in place on the site. As you have parked
outside of a marked bay, you have breached the terms and conditions and therefore the PCN has been issued
correctly.

The most crucial issue is whether you blabbed the drivers identity in your initial appeal. Unless you only referred to the driver in the third person, you likely gave away the drivers identity.

No “I did this or that”, only “the driver did this or that”.

There is no Keeper liability if the driver is not identified. I’ll bet that the Notice to Keeper (NtK) even says “non-PoFA” on it.

Yeah, unfortunately I hadn't come across this website prior to my initial response so as you say have, inadvertently, identified myself as the driver.

On that basis is there anything that can be done or am I best just paying up?
