Hi there,

In June 2024 I parked in Inverness, paid using all the coins we had for an hour and a half, ended up staying for an hour and 45 and got a parking fine. I tried to appeal it saying there was no card payment or option to pay online as we had no other cash.

The appeal was rejected and I never heard for a year until two weeks ago where I got a letter from debt recovery plus for £170.

The car is still registered at my parents but I have just moved into a new flat. Doubt registering the car at my new flat would help would it? They want me to pay it but I'm just really annoyed at the circumstances given the lack of payment options. Should also note both addresses are in Scotland.

For future reference and until the Transport (Scotland) Act 2019 introduces a keeper liability scheme, there is no Keeper liability in Scotland. As long as the unknown drivers identity is not revealed by the known Keeper, there is nothing that can be done to make the known Keeper liable.

As already stated above, there is no way anyone will try to make a claim through the Simple Procedure in the Scottish courts for a single PCN, especially if the company alleging the debt is an English or Welsh company. There is no money in it for them as it would cost them much more than they could ever hope to recover in a Simple Procedure claim.

You can safely ignore any debt recovery letters. Debt collectors are powerless to do anything except to try and persuade the low-hanging fruit on the gullible tree to pay up out of ignorance and fear.
