Interestingly, there was a recent miracle whereby the IAS cancelled a (not so) Smart Parking PCN. It was due to the usual PoFA failure.
"The Operator relies upon POFA in seeking keeper liability.
The NTK was not served within 14 days of the parking event on 29 April 25 as required by POFA. The NTK date of issue is 13 May 2025.
Paragraph 9 of Schedule 4 provides:
(5) The relevant period for the purposes of sub-paragraph (4) is the period of 14 days beginning with the day after that on which the specified period of parking ended.
(6)A notice sent by post is to be presumed, unless the contrary is proved, to have been delivered (and so "given" for the purposes of sub-paragraph (4)) on the second working day after the day on which it is posted; and for this purpose "working day" means any day other than a Saturday, Sunday or a public holiday in England and Wales.
I have considered all the issues raised by both parties in this Appeal and I am not satisfied that the parking operator has established that the Parking Charge Notice was properly issued and therefore this Appeal is allowed.
As your appeal has been accepted, the charge has been cancelled by the operator and you do not need to take any further action.

We are not sure whether the adjudicator was a wet behind the ears newbie and has since been hazed into subservience or whether the IAS is suddenly beginning to panic with the ongoing government consultation over the upcoming Private Parking (Code of Practice) Act 2019.
Historically, when PoFA compliance fails, IAS adjudicators often lean on
Elliot v Loake (1982) to infer driver liability from keeper status. But that case is criminal, not civil, and involved forensic evidence and proven dishonesty—not mere presumption. It’s been widely discredited in civil parking contexts, yet IAS has clung to it like a legal fig leaf.
They know their days are numbered as the new CoP will make them irrelevant. I'm sure (not so) Smart will also be upset that their move to the IPC has now resulted in more of their pathetic PoFA failing PCNs being cancelled by the supposedly "independent" assessors.
