As above, I received a NTK from an ANPR camera to say I did not pay and they wanted £100.

I attach the notice.

I appealed and provided proof of payment and said that if they check their ANPR they will see the car paid for never entered the car park.

I received a letter back rejecting the appeal and saying that they want £20. Do I just pay this and shut up, or do I still have a very strong case?

(Having problems attaching imagine I don’t know how to? 
Note: I have received a paper FPN for the same reason but it by the council and it was not ANPR - paid but chose wrong vehicle. Will post separately about this

Did you identify the driver when you appealed? The Notice is addressed to the Keeper because they don’t know the identity of the driver. Unless their Notice is compliant with PoFA 2012, they cannot transfer liability from the unknown driver to the known Keeper.

Yes they know the driver, the appeal denial is addressed directly to me the driver (not the keeper). Their appeal page on their website asks who the driver is, I guess that’s their sneaky way of finding out.

Deemed delivered on day 14, there may be other reasons why the notice doesn’t comply with PoFA, but they’ve offered you the ‘keying error’ £20 discount and - since they know who the driver was - I’d probably pay in your shoes. Not worth £20 of my time for the continuing saga.

To know whether or not the notice complies with PoFA we need to see all of the notice. But it’s generally a moot point anyway if they know the driver.

No as the driver has been identified and admitted to making a significant mistake you dont really don't have a strong case. The £20 covers the cost of the PCN and handling your appeal, the PCN was (not withstanding any potential POFA issues which is moot anyway). The car that entered the car park had not had payment against it. They can't go through their records looking for orphaned payment records and try to match them up. Even if they could why would they? What we need are apps that link to the ANPR so they prompt you if they haven't seen the reg you've selected enter the car park. Unfortunately most apps are seperate companies from the car park operator.

Up to you if you want to fight this, and the ongoing letters and such.

You could put them to check the VRM of the other car they may not want to, but it would be a defence point.

However, depends how keen you are or pay the £20 and end it.

I would assume they have already checked the other VRM otherwise they wouldn't be offering the £20.
