Secure parking Solutions PCN - Pentos Drive

Morning all. Its my first time I am using this website and am in need of some advice after receiving a PCN from a private parking company (secure parking Solutions)

Last month, the vehicle was parked for approximately 20 minutes on a private road (Pentos Drive (B11 3TA). It was in the night time therefore a sign showing it is a private road was not clearly visible. They state the contravention as "Vehicle parked in a No waiting/No parking area"

I would greatly appreciate advice on this matter as paying £100 for 20 minutes is unfair.

I want to attach the PCN but can't figure out how to.

Hi. Thanks. I've reuploaded and now have also included the back page. They also sent a payment form, please let me know if that is needed

You only need to obscure personal details.

I revisited the site and observed that there is a significant lack of lighting at night (when the alleged contravention took place). As a result, the signage is not clearly visible or obvious. In addition, the parking terms and conditions are displayed in a font size that appears too small to read particularly in low-light conditions. It is installed on a wall high up.

On this basis, do you consider that these factors would be sufficient grounds for an appeal?

I am very grateful for your advice and assistance. Your guidance is greatly appreciated.

The notice is not PoFA complaint meaning that they have no legal route to liability.

You could initially reply with a blunt response.




I am the registered keeper.

As your notice is not PoFA compliant I will not be accepting any liability for the outstanding parking charges.

The driver is not known to you and I will not be providing any driver details.

Your options are;

Cancel the notice

OR

Waste further money by providing a POPLA referral code.

I am sorry that I am unable to help you further.

Can you kindly, for my own reference and benefit, tell me how their notice is not PoFA complaint please. Also is the IAS referral code the one I need to submit it an appeal with POPLA?

Remove reference to IAS, that’s a mistake, or change it to POPLA.

The NtK failed to provide the statutory information and statutory legal choice required by Schedule 4 Paragraph 9(2)(e), 9(2)(e)(i) and 9(2)(e)(ii).
