Is mediator required by law to probe defence ? What if mediator says that is qualified to do so ?

Don’t be absurd. A mediator is not legally trained and has no role in probing a defence. Mediation is entirely separate from the judicial process. The mediator is simply a facilitator—someone with a few hours of training in making phone calls to each party and recording any agreement if settlement is reached.

They have no powers, no authority, and certainly no grasp of the nuances of contract law or the Protection of Freedoms Act 2012. If a mediator dares to suggest or imply how the case might unfold, or offers any view on possible outcomes, that is misconduct and should be reported immediately to the SCMS.

To be crystal clear: mediation is not law. There is no judge, no solicitor, and no legal argument. It is a voluntary, administrative exercise—nothing more.

Morning , I have received  mediator call this morning and followed your instruction . Name of the representative : Elliot Norman, mediator did not know his position and said that they do have written authority to negotiate. I’m awaiting for another call from mediator to hear the claimants response.

Hi again , received my second call  from mediator , I was told that the claimant refused to discontinue and is proceeding the court . What do you think happens next ?

Hi , I have received today a notice of Transfer of Proceedings, it does not say anything I should do. It just says that the claim has been transferred to the County Court for allocation

So if that’s all you were sent, wait for and post the notice of allocation with dates and details.
You will get something with a court date/time, a date by which the claimant has to pay the court fee, and a date by which you and the claimant has to file relevant documents such as Witness Statements. If the court fee date precedes the WS filing date, it is likely the case will be discontinued. If it isn’t, or if the documentation date precedes the payment date, you will need to file a Witness Statement.

Claimant needs to pay £27 by 19 May.
Court date is 16 June.
If the court fee is paid, then you need to file a Witness Statement by 2 June.
If the court fee is not paid, and you need to check on 20 May, then that is the end of it.
DCB Legal usually discontinues.

Ring the court if you have not received a formal notice of discontinuation by then.
