Hi,

I dropped my wife (in her car) and kids off at Heathrow T3 at end of July. I genuinely planned to pay the £5 when I got home but forgot and when I went to pay a few days later it didn't seem to allow me to backdate it the 4 days of so. She received a Parking Charge Notice about a week ago.  Shall I just use the above template as suggested? Thanks

You need to start your own thread. However, you wife, as the keeper needs to appeal as follows with no embellishment and certainly no identifying the driver as you have just done in your post:

If Heathrow Airport wanted to hold owners or keepers liable under Airport Byelaws, that would be within the landowner's gift and another matter entirely. However, not only is that not pleaded, it is also not legally possible because APCOA is not the Airport owner and your 'parking charge' is not and never attempts to be a penalty. It is created for APCOA's own profit (as opposed to a byelaws penalty that goes to the public purse) and APCOA has relied on contract law allegations of breach against the driver only.

The registered keeper cannot be presumed or inferred to have been the driver, nor pursued under some twisted interpretation of the law of agency. Your NtK can only hold the driver liable. APCOA have no hope at POPLA, so you are urged to save us both a complete waste of time and cancel the PCN.

Email, yes - that's how they'll respond to your appeal. Phone number, no. If it insists you put something in, just put all 0s. Otherwise leave blank.

Apologies. Should have replied at the time to say that shortly afterwards we received an email saying the PCN was cancelled. So great result and thanks for the advice. Much appreciated.
