Have now been given my mediation appointment - Are we hoping it gets struck off before this point or after the call?

No. The strike out is likely to happen at allocation stage when the claim is assigned to your local county court and a case management judge reviews the claim and the defence.

As for the mediation call, that is nothing to do with the judicial process. There is no judge or lawyers involved at this stage. Only a minion with no legal training who has had a day course on how to handle these calls. All you do is offer £0 and it will be over within minutes.

Do not enter into any discussion with the mediator about your defence. If the mediator tries to ask about it, simply tell them that the claimant has a copy of the defence and they can refer to it. It is not appropriate to discuss legal arguments in this call with a mediator who is unlikely to be legally trained.

Hi FTLA community and b789 in particular!

I have had a Notice of Allocation to the Small Claims Track (Hearing) letter in the post, which has a date and time in July for my hearing at Court...

Is there still chance for this to be struck off, or am I indeed heading to Court?!

There are some terms imposed by this order I need to comply with, specifically
6) Each party must deliver to the other party and to the court office copies of all documents on which that party intends to rely at the hearing no later than 4pm on June 17th 2025.

This is all getting very stressful and scary. Please do help out where possible ...

Can you show us a redacted copy of this document? It usually sets a date by which the hearing fee must be paid by the claimant. They usually discontinue before this falls due.

As above Do not just paraphrase bits of the order. Show it to us and leave the judges name showing too. All dates must be left visible.

The odds of this actually getting as far as a hearing is very low. What is the trial fee deadline for the claimant?

Apologies - here is the letter. I also received a bundle of docs from Gladstones, which is the Claimants Witness Statement.
Really silly / frustrating its gone this far.

So grateful for your help on this matter.

Actually, that's not been my experience with Gladstones.  While DCB Legal generally discontinue in the way you indicated, I find that Gladstones tend to go all the way and hire ELMS Legal or LPC to send a newly qualified barrister to argue the case at the hearing.

No Gladstones issued claim ever complies with CPR 16.4(1)(a) and if pleaded properly and highlighted in your WS as a preliminary matter, it has a high chance that it will be struck out. A WS made by a paralegal in the employ of the bulk litigator is hearsay and can easily be argued against.

Gladstones are staffed with incompetent wannabe legals and should not be feared.

Please upload their WS (relating only personal info) to DropBox or Google Drive. Once we've had a chance to review it we can advise on what to put in your own WS.

Hopefully you are now in the hands of @Nosey Parker. However, that WS from the claimant is a joke and should be ripped to shreds with your own. Made by a paralegal and is hearsay.

The supposed contract with the landowner is a joke and appears to have been composed by an illiterate child. The signatures and dates are redacted. Who is the "British Association" that something is "in accordance with sections 71. and 7.3 of the Code of Practice" that authorises PPS to carry out enforcement at the location?

The PCN does not evidence any contract being formed with the driver as it does not show the vehicle parked for longer than the minimum consideration period for one to have been agreed to.

The list goes on but I couldn't be bothered to try any more as you could at least arrange the photo in some semblance of order. I'm sure this will be an easy win should it actually progress as far as a hearing.

Yes you're right - even the photo shows me sitting in the car(!) with break lights on, so perhaps we could even make the case that the car wasn't parked when this ticket was issued.

I have tidied up the naming format of the files in the google drive, not sure why they didn't organise in the order I uploaded, sorry for that inconvenience.

I really hope it gets waived before actually going to court. Do I need to prepare my own WS before the cut off, or will there be chance its struck off beforehand?
