Private Parking Charge Notice

I received a letter dated 25th September from BW Legal on behalf of Premier Parking Solutions Ltd demanding £170 (£100 PCN charges plus £70 debt recovery costs) for parking at 16.42 on 12th August at Coronation Park Helston.  This used to be free after 16.00 hours and I made the mistake of not looking at the signage so admit I should pay something.  However the signage states that the charge PCN is £60 if paid within 14 days or £100 within 28 days.  I had no opportunity to do either as the notification from BW Legal was the first I had heard of my error. I have contacted BW Legal to point this out and await their response.  Advice from you would be welcome.

Please show us exactly what you sent to BW Legal - we could do with checking you've not said anything that may be counterproductive to your case.

As you have said you didn't receive the initial letter it would be a good idea to get your car's V5C document out and check it contains the correct address.

Never ever admit to liability in any private parking issue. It is about the worst possible thing you can do. You are low-hanging fruit on the gullible tree and need the advice you will receive here if you don't want to be picked off and extorted.

As requested by @DWMB2, we need to see the correspondence between you and BW Legal. Also, show us the original Notice to Keeper (NtK). We don't need to see any reminders or debt collector letters. Just the original NtK and the comms between you and BW Legal.

Address on V5C is correct. 

Sorry if admitting to BW Legal that I had been in the wrong as far as the actual parking and not paying was concerned was a daft thing to do. However my dispute is with the amount - £170 when I had no opportunity to pay the original charge of £60 because I had had no notification of the PCN.  I haven't kept a copy of exactly what I said to BW Legal but having admitted to parking I said something along the lines of that due to not receiving the PCN any earlier than their letter of 25th September I could neither pay nor appeal within the 14 days and would therefore like to contest the amount of £170 which is out of all proportion.

The matter is now on hold at BW Legal until they reply which should be in 7-28 days.  I'll let you know what they say.

I have received a response from BW Legal saying I still owe £170 and that the time for appeal has closed.  I want to send you the original PCN and email from BW Legal but am being told the upload folder is full.

The address on the PCN matches that on my V5C and is correct but it never arrived - it was therefore impossible for me to pay the £60 or appeal before the time expired.  Incidentally the date of posting the PCN to me was 21.8.24 while the date of parking was 12.8.24.  Given the state of the post these days, even if it had arrived the initial period for payment of £60 or appeal might well have expired.

The PCN was never £60. It was always £100 with a "mugs discount" of £40 if you made their life nice and easy by not contesting it.

Please follow the guide and show us the Notice to Keeper (NtK) and the BW Legal letter. Make sure you leave all dates and times showing on the NtK.

You are where you are right now and you need to contest it. The added £70 is not normally allowed by the court if this ever went as far as a claim. As for not receiving the original PCN and the remainder, nothing unusual with that from PPS, a thoroughly nasty firm of ex-clampers.
