Fined by private company for stopping on public double yellows

I was given a fine by a private company (Euro Car Parks) on what I could only assume is a public road. I've left the exact location in the following link.

This area is essentially a scam set up by the parking company. They own the hotel's tiny car park and have a guard there all day. The second you leave your car to check in (And ask the staff where the hidden car park is which is located behind an unmarked road gate) you will be given a ticket.

I've obviously submitted an appeal but this company is well known for never cancelling fines.

Welcome to FTLA.

Your account of events is somewhat confusing. You state that your car was parked on what you believed to be a public highway, then say that the parking company "own the hotel's tiny car park" (which you say your vehicle not parked on). From Google Street View I can't tell which parking company operates the car park at the Travelodge, but the signs don't look like Euro Car Parks signage, so it's likely nothing to do with the hotel. I can see from Tower Hamlet's Highways Register that Oregano Drive is a private road.

If you would like advice we could do with seeing:
  • The notice you received
  • A copy of your appeal
  • If you can get them easily, photos of the signage in the area (or lack thereof)

What usually happens with Euro Car Parks charges is the following:
  • Appeal rejected
  • POPLA appeal - if successful, end of process, if unsuccessful, as below:
  • Series of debt collector letters over a period of some months
  • Eventually, a Letter of Claim, followed by a claim in the County Court
  • If you defend this with our help, Euro Car Park's solicitors, DCB Legal, will eventually discontinue proceedings at the last minute

After some further help on Reddit it seems it is a privately maintained road but is not obviously sign-posted and completely blends with the rest of public roads. Car parks have plenty of signs to make it clear that you are entering a contact with them but in this case there is no obvious distinction between public and private. No doubt there is some sign placed somewhere with a big block of text that they can use to make arguing against this difficult enough to make it not worth my time

The signage on private roads where parking is managed by one of these operators is usually very poor - the existence of signage is not on its own enough for them to win a case. If you can show it is shoddy, then you may be able to convince a POPLA assessor to uphold an appeal - they're sometimes reluctant to rule on signage, but I won a POPLA case on the basis of poor signage very recently so it's not impossible.

As I said previously, even if you had no viable defence (which is probably not the case from what you've told us so far), if you're prepared for a bit of effort, you can almost certainly avoid paying anything, with the process going as below.

Only low hanging fruit on the gullible tree pay an ECP PCN. To cut a long story short, whatever you appeal to ECP or POPLA will be rejected. Ignore all the debt collector letters that will follow, which are useless and can be safely ignored, and come back when a county court claim is issued through DCB Legal. We will provide a simple defence and in due course the claim will eventually be discontinued.
