PCN - Passey Place - Eltham - was at work
« on: »
Hi all, I've been issued a PCN for parking in the above car park at a certain time and date. Well, that time and date is while I was at work in central London. It would have been physically impossible for me to be there and I've said so in an appeal to Parkingeye, who have rejected the appeal stating that I still need to pay them.
I'm not going to, obviously, and will appeal to POPLA but I don't really trust them either having spoken to them on the phone today.
I can get CCTV from my office to show I was there at 4:30pm, so it will have been physically impossible for me to be there and parked by quarter to 5.

My concern is:
They will try to still argue that the car was there (also impossible as it was on my drive when I got home during the time they say it was parked there)
They will say I cannot prove the car wasn't there, only that I wasn't
That if I don't pay it, I'm not going to, there will be debt on my house and car - is that a silly concern?

any advice welcome

Yes.

There is zero risk of any "debt on your house and car". Unless a debt claim went to court and you lost and then didn't pay the debt within 28 days of judgment, there can be no damage to your credit history.

For now, please show the back of the Notice to Keeper (NtK). Is there any possibility that the vehicle in the evidential phot has a similar VRM to your yours?

Hi there,
Ok, thank you. It looks to be the correct license plate, but I have no idea how that's possible.

you've shown us your VRM on the reverse of the NtK. You may as well show us the VRM in the evidential photos on the front of the NtK so that we can maybe see if there's a chance of there having been a misread by ANPR.

I don't think so, as I can see it in the photos.

I think they have used an old photo (I parked there once in March or April this year) and added it to this false claim. I know that's quite a leap, but there is no other explanation.

The photo is also incredibly dark so you cannot see any details or passengers

Any defence should focus on what you can demonstrate and how you can do that. Gathering evidence to support the position that the vehicle was wasn't there would be sensible.

I'd say the chances they have taken an ANPR image from March to invent a charge in October is extremely slim. ParkingEye are making enough money that there is almost no incentive for them to invent a charge in that manner, the risk vs reward just wouldn't add up.

Something has clearly gone wrong somewhere, but we don't really know what.

The evidence I am submitting is:
CCTV footage of me at my office at around 4:30pm (in central London)
Emails demonstrating a meeting that ended after 4:25pm
Maps showing it takes over an hour for me to travel home from the office, thus it being impossible for me to have parked there at that time.

My car was at home, on my drive.

Can I ask why I would gather evidence to support that my car was in the car park, when it wasn't, or is that a typo?
