PCN Horizon Parking for ASDA - Failure to Pay

Hi All,

I've read around the forum including the sticky topic and found a lot of it useful, thank you!

I think my situation is quite similar to this thread started by Mocede28 https://www.ftla.uk/private-parking-tickets/horizon-parking-charge-tesco-overstay/ - or at least, the wording of the PCN issued to me is the same (with the obvious exception of the actual particulars).

Please can you confirm the best way to go about appealing this?  Is the wording non compliant as suggested in the thread by Mocede28 and could I appeal to Horizon Parking under those grounds?  Specifically, could I respond to Horizon using the same template as suggesting in this post on that same thread https://www.ftla.uk/private-parking-tickets/horizon-parking-charge-tesco-overstay/msg43589/#msg43589

Also, thoroughly bemused to note that the parking fines have gone up so much - my ticket is £60/£100, a month previous Mocede28's ticket at £40/£70.  The period for the reduced fee has also halved.  What's going on there?  Is it just different local authorities issuing different guidance?

Edit: for clarity, I received the notice on the 7th December 2024, and haven't responded as yet at all.

This is nothing to do with local authorities, it is a private parking notice (not a FINE).
Different operators do charge different amounts.

Anyway, as you've spotted, there is the same PoFA issue as in the other thread you found, so you could use that same appeal. If you haven't already, you could also try to speak to the management of the ASDA store to see if they will intervene.

just a thought. would it be prudent to keep the drivers identity undisclosed from ASDA incase they forward details to Horison.

There is no need to provide the drivers identity to anyone. When dealing with Asda, the OP is the Keeper and simply refers to "the driver did this or that". Do not say "I did this or that". As the Keeper, you refer to the driver in the third person.

Thanks DWMB2, I've submitted the appeal through the Horizon Parking portal and will report back once I have an answer - they say up to 28 days but with Christmas and New Year holidays I wont hold my breath!

Be careful of any drop down boxes asking for "Driver"
Appeal as the Keeper or other.

Asda Customer Service: 0330 053 0111 have the authority to cancel tickets from this operator over the phone. If you call them and this is the first time you have received such a ticket for this location, it is highly likely they will.

I hadn't heard from Horizon regarding this one so I checked online and realised I had missed this email in my junkmail... https://imgur.com/a/TXyJafG

They have rejected my appeal and what's worse is I didn't see this until now so I don't know if their 14 day reduced fee still applies. 

EDIT:  And it looks like I've missed the boat for the Popla appeal.

Any thoughts?

Did you follow the advice of @M456 as noted above, which should have been your Plan A?

As your initial appeal has failed, you now have until 1st February to submit a POPLA appeal. Plenty of time and you should still be trying Plan A to get the landowner or their agent to get the PCN cancelled.

If Plan A does not work, then put together what you think is a POPLA appeal and show it to us before sending anything. You can search the forum for examples of POPLA appeals. Remember that POPLA does not consider any mitigation, only points of law or the PPSCoP.

Did you follow the advice of @M456 as noted above, which should have been your Plan A?

Yes I did I have called that number several times in December - they give you a menu and there isn't an option for 'cancelling parking charges' so I tried various departments before giving up.  I spoke to several customer service agents who all said they can't help.

HOWEVER!  Your reminder did help in that last night I happened to be driving past the store and just popped in and asked politely what we could do. They have cancelled the charge.

The lady I spoke to said if I can show I did spend money in store that day and stayed for less than 3 hours, they'd cancel it no questions asked.  The parking charge letter had my entry and exit times and it was well under the 3 hours (although I now know the signage states only 1 hour!).  She wrote on the parking charge letter itself her name, the date, and that she'd seen evidence that I'd been a customer - she said a receipt is best but she was happy to just see the transaction on my banking app to prove I had been a customer on that day). 

She then kept the letter after I took a photo of it for my own records.  She placed it on a whole pile of letters that looked the same so I guess this is a common thing at that Asda.  I asked if they would contact me and she said no, she doesn't think so, but that I should be assured it's been cancelled.  I suppose it will take a few days for the Horizon Portal to update.

So I think the advice should be go direct to the store if you can.
