PCN - Estate Parking Wing Security Limits Haringey

I initially thought this was a private PCN, but apparently this is a council PCN managed by Wing.

The driver parked in an estate, and the PCN was issued on car window.

See image of PCN below. I’ve read conflicting advice online with regards to whether this should be appealed/paid. Can someone pls advise?

I am inclined to think it is private - it talks of Parking Charge, not Penalty Charge, and the amounts are odd: £100 discounted to £60.

I would move this to the Private Parking Forum, but will wait for others with knowledge of Haringey's devious parking practices.

Just checking Haringey's site, and found this

So Haringey have out-sourced council estate parking, but will be bringing it in-house.

So have moved this to Private Parking.

This is a private parking issue.

The use of the word Haringey and its format are deceitful, this has nothing to do with Haringey Council (whose corporate logo they are mimicking) as an Enforcement Authority acting under the authority of the Traffic Management Act and regulations.

It also doesn't come under the umbrella of the Protection of Freedoms Act 2012 whereby a registered keeper may be held liable for the 'sins' of a driver because in order to avail themselves of this right a creditor must satisfy conditions and in this case they've fallen at the first hurdle because they,Wing Security Limited, are not an Approved Operator of an Accredited Trade Association.   

Do not on any account contact them.
Do not try to explain anything to them.

Come back here if the registered keeper receives correspondence on this matter.

You can safely ignore it. Nothing will come of it. Wing are not a member of any accredited trade association and have no access to the DVLA.

They have no idea who the driver or the Keeper is. Just ignore it.

I recently submitted an FoI request to Haringey about this company and the following is the confirmation received from them:

a. Is the land at or near Miles Road, N8 where the sign is located owned, leased or managed by Haringey Council?

The section of Miles Road, N8 where the sign is located is private land managed by Haringey Council

b. If so, please provide the title reference and a description of the Council’s legal interest in the land.

The land in question is within the Council’s ownership under Land Registry freehold title no. NGL487212.

2. Authority for Parking Enforcement

a. Has Haringey Council entered into any contractual agreement or memorandum of understanding with Wing Security Ltd for the purposes of parking enforcement at this location?

Wing Security Ltd are under contract with Haringey Council to enforce parking on certain estates managed by Haringey Council, as indicated by appropriate signs.

b. If yes, please supply a copy of that contract or agreement, redacted only where strictly necessary.

A copy of the contract we have on file has been attached. Please note that the contract has since been renewed and an extension awarded.

We are working with colleagues in strategic procurement, which we will be able to provide in due course.


3. Use of Haringey Council Branding

a. Has Wing Security Ltd been formally authorised to use the Haringey Council logo or branding on parking signage?

Yes.

b. If so, when was that authorisation granted and for what purpose?

Wing were instructed to provide signs including the Haringey Council logo in May 2022, for introduction from June 2022 following the incorporation of Homes for Haringey back into Haringey Council.

4. DVLA Data Access

a. Has Haringey Council authorised Wing Security Ltd to act on its behalf in obtaining DVLA vehicle keeper data for the purpose of issuing Parking Charge Notices (PCNs)?

Wing Security Ltd are unable to access DVLA keeper information.

b. Does Haringey Council itself access DVLA data in relation to alleged parking contraventions at Miles Road, N8? If so, please confirm under what statutory powers.

Haringey Council does not currently access DVLA data in relation to alleged parking contraventions at Miles Road, N8.


5. Type of Enforcement

a. Is parking enforcement at this location conducted under the Traffic Management Act 2004, local byelaws, or via a private civil contractual model?

Parking Enforcement at this location is currently managed via a private civil contractual model.
