Notice of transfer of proceedings

Hi

I have done my mediation session two weeks ago or so with DCB legal / UK parking control, said Zero settlement. I was expecting for them do drop everything as thats what I read happens. But have now got a notice of transfer of proceedings, and its been transferred to county court at central London.

is this normal or does this mean its gone to the next stage and they have paid more fees.

Are you in central London? If not ask for it to be transferred to your local court

It’s normal but you need to insist on your local court.
They only discontinue later, once the court has been allocated.

F1 in your Directions Questionnaire should indicate your local court. Did it?

What did you put in your N180 DQ form for your local court? Which would be your local county court?

They will eventually discontinue but not until just before they have to pay the trial fee which will be approximately a month before the hearing date.

Thanks all, yes i put my local court down as 250 miles away from london. also stated i am a career for my mum.  How to i make them transfer it now ?

You need to send the following email urgently to the CNCB at CaseProgression.cnbc@justice.gov.uk and CC in yourself. Include a copy of your N180DQ:

Subject: Urgent Request to Correct Venue – Claim No. [XXXXX]

Dear Sir/Madam,

Re: [Claimant] v [Defendant] – Claim No. [XXXXXXXXX]

I am the Defendant in this matter. I respectfully request urgent correction of an administrative error concerning the transfer of this claim.

My N180 Directions Questionnaire clearly requested that the hearing be listed at my local county court, [insert name of local court]. However, I have now received a Notice of Transfer indicating that the case has been allocated to Central London County Court, which is approximately 250 miles from my home.

This appears to be an administrative oversight. I am also a full-time carer for my mother and unable to travel long distances, making this venue entirely unsuitable.

Please rectify this error and confirm that the case will be transferred to [local county court] in accordance with CPR 26.2A(2) and the overriding objective.

You should also send the following to the Central London County Court at    Enquiries.centrallondon.countycourt@justice.gov.uk and again, CC yourself:

Re: [Claimant] v [Defendant] – Claim No. [XXXXXXXXX]

I am the Defendant in this matter. I have received a Notice of Transfer stating that the case has been transferred to Central London County Court.

However, this transfer appears to have been made in error. My Directions Questionnaire (N180) stated that the matter should be heard at my local county court, [insert name of local court], as I am a full-time carer and cannot travel significant distances. Central London is over 250 miles from my home.

I have contacted the Civil National Business Centre to request that the case be re-transferred to the correct local venue. Kindly suspend any further action on this file while this is being resolved.
