Hello all.

Thanks for taking the time to read this. Essentially, I received a parking ticket for using the KFC drive-thru for 13 minutes at 02:20am. KFC is open until 03:00am. I appealed this, providing a copy of my bank statement dated with a purchase from KFC. The appeal was rejected and I was offered a discounted fine of £20.00, with an option to appeal through POPLA.

What can I do?

Thank you for your reply. I've added the original PCN, however I'm unable to find my original appeal.

I basically said something along the lines of "I was using the KFC drive thru as it was open until 0300hrs, whilst PCN shows 0220hrs. Attached is a receipt of the KFC purchase dated 7th December 2024"

I can only see half of it, the back page seems to be missing. It is also titled 'reminder' - do you have the original?

Also, this was the first letter I received about this PCN, nothing else was delivered.

What did KFC say when you complained to them that as a patron of their restaurant, you have been unfairly charged £100, now reduced to £20 by a third party that they have contracted?

What you've shown us is the Parking Charge Notice (PCN) that was originally issued as a postal Notice to Keeper (NtK) Reminder. You need to show us the original NtK that was received. The reminder is useless to us if you want advice.

Depending on what the contractual signs actually say at the location and the fact that it was open for business at the time and you have evidence of being a customer, why not submit a formal complaint to ParkingEye and telling them to research the response given in the case of Arkell v Pressdram (1971).

Thank you for the advice.

I never received a notice to keeper, only a reminder. I didn't bin it by mistake, I just never received it so I'm not sure where it went.

I also haven't complained to KFC as I assumed it would be cancelled with my evidence, but now I'm worried I've got limited time before the fine goes back up to £100.

Do I appeal through POPLA?
