Really?

How about explaining that you were a customer of Lidl (show a copy of a receipt) and you would like them to get their agent to cancel the PCN as it has been issued unfairly. Explain that as the contractor, they are jointly and severally liable for the actions of their agent and you intend to challenge the PCN all the way to court if necessary.

PE have no evidence that the driver who was operating the vehicle was the same person as on the first visit. The PCN is issued against the driver, who is unknown to them and there is no legal obligation to reveal the drivers identity to an unregulated private parking company.

Do I have to go on? Please use some imagination when putting together a request to the landowner.

Shopped at Ilford Lidl many years and  on the 13/10/2024 spent £50 on shopping only to forgot the water bottles returned to lidl and a few days later received a PCN for £100, £60 if i pay within the date of issue of the letter. Parkingeye assume it was the same driver on both trips can they prove this ? I have attached the pcn and the receipt for that day

Who is that to? If Lee Baron, that's no good as it doesn't actually ask them to cancel the charge, which is the whole point of getting in touch with them!

Also, given that one of your appeal/Defence points is going to be that ParkingEye do not know who was driving on each occasion, it is probably wise to not strongly hint at who was driving when writing to anyone, even the landowner.

Err... not quite. You are attaching "copies" of the PCN and the receipt, hopefully.

You are writing as the Registered Keeper of the car. No one except you know the identity of the driver/s. You are telling the estate managing agent that, as the keeper, you have received a PCN from PE. The driver was a customer of Lidl and spent £50.

PE, their agent, has issued a speculative invoice for £100 to you, the keeper, because the vehicle returned within an hour. There was a legitimate reason for the vehicle returning as it was to pick up some items that had been forgotten.

If they do not get their agent to cancel the PCN,  you intend to challenge this all the way to court if necessary and as they are jointly and severally liable for the actions of their agent, they should be prepared to be named in any claim and counterclaim.

You're the keeper, not Lee Baron. I'd also maybe adopt a slightly less confrontational tone upon first contact, and strengthen as necessary down the line, but that might just be me.

How about this:

Dear Sirs,

I am writing regarding a Parking Charge Notice issued by your agent ParkingEye to me, the registered keeper of vehicle [VRM] at Ilford Lidl, land managed by Lee Baron. A copy of this notice is attached.

On the occasion the parking charge was issued, the driver of the vehicle was a customer of Lidl, and therefore a legitimate user of the car park. I have attached a receipt from Lidl confirming this. The charge was apparently issued because the vehicle returned within one hour, but ParkingEye have failed to provide any evidence that it was the same driver on both occasions, which would need to be the case for the alleged contravention to have occurred.

I am sure that when you hired ParkingEye, your intention as the managers of this land was to deter misuse of your car park, not to penalise legitimate customers of the retailers on your land, as has happened in this case. With that in mind, I kindly request that you instruct ParkingEye to cancel this unfair charge.

If ParkingEye continue to pursue the matter I will have no hesitation in defending my position, up to and including court if necessary, where Lee Baron may be held jointly and severally liable for the actions of their agent in any claim and/or counterclaim. I hope that it will not reach this stage, that common sense will prevail and the charge will be cancelled.

What are you asking? Did you include a copy of the PCN when you contacted Lee Baron? It would appear not and the response you've shown us kind of confirms that. So, why not respond to that email and provide a copy of the PCN.
