ParkingEye - Overstay - Lidl, Usk Way Newport Wales

Hi guys, looking for advice

Driver went shopping at Lidl's under the impression there was a 2 hour limit as another driver asked about it a couple weeks prior, had to crane their neck upwards and squint at the tiny sign to confirm. Driver is a slow shopper but also popped round to another shop across the road

Received a Parking Charge Notice for a 30 min overstay from ParkingEye, So spoke to store manger and presented the receipt but was told they don't own the land and too many recalls have been made so ParkingEye no longer accept requests from them, so appeal to them directly. Of course, they denied the appeal stating they don't have evidence that a charge isn't owed.
POPLA also denied even though I pointed out no keeper liability etc. (they failed to identify the driver or INVITE THE KEEPER)

I have since misplaced the receipt in the intervening months and forgot about it until I received a final demand for payment in the post

Sent a message to the CEO a couple days ago and got a response from the customer care team asking for a contact number to discuss, should I accept the call and identify the driver? Any details I should bring up or avoid, or should I just play the legal chicken game with ParkingEye, possibly taking it to court?

Ah, adblocker was hiding that bar from me, however imgur is reporting over capacity at the moment, is there another option? Can't seem to directly upload to this site unless I'm missing something

I did, customer care wants to call to discuss. What should I say? is it ok to identify the driver?

Can anyone clarify if identifying the driver to Lidl will result in liabilty being transferred to driver or is there a time limit?

I don’t know exactly what you’re asking, but the driver is always liable for their actions, but the registered keeper is never required to identify the driver. PoFA 2012 provides a legal framework under which the liability can be transferred from the (unknown) driver to the (known) registered keeper.

I know, I'm asking if I(the keeper) should accept a call from customer care, during which they will probably ask the identity of the driver?  Sorry for any confusion

Why would you be asked by Lidl to identify the driver? All you have to say is that you are the Registered Keeper (RK). On the date in question you were a customer and you expect Lidl to get the PCN cancelled.

Just because you are the RK, doesn't mean you were or were not the driver. The RK could just as easily been a passenger in the car. There can be no inference or assumption that just because you are the RK that you must also be the driver.

As the RK, you are under no legal obligation to identify the driver, irrespective of who it was. All you have to do is refer to the driver in the third person. No "I did this or that", only "the driver did this or that".

In the E-mail to the CEO, I stated the driver was a customer, so do I say that I was a customer, the driver or both? Without a receipt they may check cameras so I don't want to misrepresent the facts.

An E-mail is easy enough but a person on the phone may want the story to make a decision maybe? Never done this before so I'm not sure how the conversation would go

In what way can they “check cameras”?
I suggest you’re inventing things!
In the unlikely event they actually have moving camera footage rather than just a picture of your number plate, this doesn’t enable them to do much anyway.

Just stick the the RK line.

However this does demonstrate why elsewhere we advise people to do everything in writing. If a phone call will get you off the hook here, go for it, but try not to say the wrong thing.

jfollows, I was referring to Lidl's CCTV, not ParkingEye's ANPR

I agree though, I would prefer all correspondence in writing, but when I messaged Ryan Mcdonnell, a customer care agent responded on his behalf saying sorry to hear that, could we give you a call to discuss

What do you suggest I do at this point?
