Hello, i am hoping someone here can give me some advice

Parking solutions LTD tried to take me to court to claim £267 for a 60p 15 minute stay at a car park in 2020 during covid times

The money claim online process looks like this

Claim History

General sanctions order was made on 26/09/2023

The claim issued against you was struck out on 28/11/2023

DQ filed by claimant on 27/01/2025


I am really confused if the case was struck out why have they now 14 months later submitted a DQ and now i have been invited to mediation?

is this an error?

do i have to attend?

Does this mean the case has been restarted?

I am just really baffled how this can be done it seems like an abuse of process

any help would be appreciated

Something certainly seems amiss.

It would be useful to see some documents here - it seems unusual that the MCOL timeline starts with a general sanctions order.

Perhaps in addition to the MCOL timeline you have shared, you can provide us your own timeline of your understanding of events, what you received when, what you submitted when, etc.

i am assuming the sanctions were because parking solutions ltd never bothered to file a DQ in the original timeframe

Apologies if this sounds blunt, but b789 asked 3 questions and you have only answered 1.

In your opening post, you created the impression your MCOL history started with a general sanctions order. It then transpired there were 6 entries before that.

The quality of advice we're able to give is dependent on the quality of the information you provide us. We need details to understand what's gone on here.

it's hard to remember as this was years ago and was assumed finished and forgotten about

the part admission was me just saying i'll pay £100 to make this go away, i couldn't deny the whole claim as i did park somewhere that was a paid car park despite it not being that obvious at the time

What is the situation of them filing a DQ after the claim has been struck out are they just trying their luck? i have not received their DQ either and the mediation is in 8 days

Do you still have the paperwork that was sent to you originally? If the claim was struck out, you will have received a copy of the order saying so.

In light of the scarcity of actual facts, I suggest that the following is sent as a formal complaint to the CNBC using their online complaints webform here:

You can provide contact details and you will need the claim number.

Use this as the complaint:

Despite this, the claimant has filed a Directions Questionnaire (DQ) on 27/01/2025. Since the claim was struck out, this DQ submission is improper and should not have been accepted or processed.

The failure to properly manage this case has caused me avoidable stress and inconvenience. I request that CNBC considers awarding appropriate compensation for the distress and time wasted in dealing with this matter.

* Confirm in writing that the claim remains struck out.
* Confirm that the claimant’s DQ filed on 27/01/2025 has no effect.
* Ensure that no further action is taken unless the claimant properly applies for relief from sanctions.
* Investigate why CNBC accepted a DQ for a struck-out claim and confirm what corrective actions will be taken.
* Consider compensation for the distress and inconvenience caused by this procedural failure.

I have no paperwork and also i never received any paper work about the claim being struck out as far as i remember

I will try the below you suggested, in the meanwhile should i still attend the mediation? it's on the 12th, from reading reviews online emails are almost never answered from the cnbc

Wait for their reply. Any mediation is irrelevant and whilst you are obliged to "attend" the call, it is not part of the judicial process and no judge or solicitors are involved. You can tell the mediator that you have submitted. complaint to the CNBC because this clam was struck-out over a year and a half ago and until you hear back from the CNCB, the whole issue is an abuse of process. You offer £0 and that is the end of that.

What I am finding a bit strange is that you claim not to have received any paperwork after receiving the claim, defending it and submitting your own DQ. Are you saying that you never received any of the General Sanctions Orders or the Order striking out the claim?

Did you change address at some point in the middle of this process and not inform the court?

Did not change address i received correspondence saying that a sanctions order was imposed and i was really confused and stressed about the situation because i submitted the dq as requested but then after i logged on i realised that it was them that the sanctions had been placed on because they never filed their DQ (they word these letters horribly) it's weird because it seems like they were sanctioned for no dq then sanctions were lifted then they were sanctioned again for no dq and then the case was struck off? I feel like they just do these processes in the hope of everyone being scared and capitulating and just paying the request on mcol as they really did not bother to follow any process which was asked of them.

this is my first time dealing with this process and the whole system was confusing and stressful especially when you have no advice or anywhere to turn to , i am glad i found this website and i really appreciate your response

i will attend the mediation hearing and state what you suggested and i have emailed them and also submitted a complaint so hopefully that covers me

Do you still have a copy of both General Sanctions Orders? If so, please show us. Are you adamant that you never received the Order with the strike out?
