Parking charge Notice in Tesco

Received this penalty from Tesco car park for overstaying even though I had my blue badge clearly displayed.Any help would be appreciated. I thought I could park for 3 hrs.

First thing to do is edit your post on here. Do not reveal who was driving. "The driver" parked and you'll deal with this as the keeper.

Unless stated on the signage, a blue badge affords no additional privileges on private land.

However, as this is a Horizon charge, send an appeal along the lines of the below:

Dear Sirs,

I have just received your Parking Charge Notice to Keeper _____ for vehicle VRM _____

You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, to give the notice of keeper liability in the format prescribed by section 9 (2) (f) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

There is no legal requirement to name the driver at the time and I will not be doing so.

I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

Yours etc
If you appeal online, make sure you do not tick any boxes etc. revealing who was driving, and check your spam folder for the response. If by post, send it regular first class, getting a free certificate of posting from a post office.

Were you actually shopping at Tesco? If so, producing a receipt or even just an entry on a credit card statement would be helpful i.e. I was a bona fide customer and I am sorry I overstayed a bit. Generally works better to take this side up with Tesco management in store.

Given that I've just advised the OP to not reveal the identity of the driver, it'd be wise for those replying to avoid doing the same.

You're right that contacting the store is generally a wise course of action, but from what we see here and on PePiPoo, the appeal template I suggested above yields consistent success with Horizon.

Fair enough. The approach to Tesco in-store (my wife has done this successfully after a megashop and negotiation over a Clubcard that exceeded two hours) works well if you are a genuine shopper. I surmise that OP in this case perhaps wasn't so sticking to your template is probably best.

So when i reply i shall state my name and address as the registered keeper of the vehicle but will not divulge any information about the driver.

Correct. The template I suggest above can be used verbatim, filling in your details as keeper.
