Hi everyone,

I’m looking for some advice for my sister who is in a bit of a mess with some mainly old parking tickets. She’s currently not working and on paternity pay, and the stress of this is starting to get to her.

She has 4 outstanding tickets in total (3 from Morrisons Wood Green and 1 from Tottenham Hale). She ignored them at the time because of that old and clearly wrong advice that you don't have to pay private fines.

Three of the tickets are from around 2021 period in Morrisons Wood Green. Debt Recovery Plus (DRP) is now chasing for a total of £595. They sent a "Letter before referral for legal action" for one of the 2021 (01/12/2021) one recently, saying she owes £151.10 for that single ticket.

The main issues:

She tried to offer them £10 a month because she’s on paternity pay and has no other income. They refused it and demanded £70, then £50. She missed the first payment because she literally doesn't have it, they threatened to refer it to bailiffs if she didn't setup a payment plan and make pthe payments.

We don't have any of the original letters or photos because they’re from years ago. She might be able to find the most recent one which apparantly was from a few months ago in Tottenham Hale.


Is there any way to get them to accept a lower payment or just leave her alone while she's on maternity/paternity leave?

Any help would be appreciated.

To start off with, we need to see copies of any correspondence between her and ECP, or any debt collectors acting on her behalf.

In particular we need to see this communication whereby she has offered to pay them in installments. At face value this doesn't sound ideal, as it could be taken as an admission that money is owed, particularly if said offer wasn't made on a without prejudice basis.

I can upload the one letter I've seen from Debt Recovery Plus later. 

I just spoke to my sister to ask her if she had anything about the payment plan.  She said she didn't have any letters and that she set it up over the phone.  She gave them her bank details after agreeing to pay £50 per month.  She said they called after the payment failed from her account.

It sounds like it may be too late to do anything possibly as when asking her a few more questions this is not the first payment she will be making, she said that they took a payment previously.  I guess that is likley a closed case? She had ballifs around for other tickets before and said she didn't want to be in that situation again.  I guess the best thing to do for now would be to lend her the £50 for her to pay this months payment?
