District Enforcement Ltd - PCN - Lord Mayors Drive

Received a "PCN" from District Enforcement Ltd, will follow with a picture of the front and back soon.

I replied stating the identity of the driver is unknown to me as the car is shared amongst a few family members. If I really wanted to, I could probably drill down and work out who was driving the car, but that seems like a lot of effort that will only end in District Enforcement's favour.

They have replied saying "however if you are unable to provide the details of the driver at the time of the contravention, as the notice was sent in line with PoFa we can hold the keeper of the vehicle responsible for the Parking Charge Notice."

Is this accurate? Unsure how much effort to put into this over £35!

Unless you show is the NtK, both sides, with all dates and times unredacted, it is impossible to say whether their notice if PoFA compliant or not.

Why have you redacted the timestamp? Is there only a single timestamp? Is there a “period of parking” stated?

Their Notice starts off with:

We are writing to inform you that, as the driver of the above vehicle, you are liable for a Parking Charge of £70 which, as of the date of this notice, remains unpaid in full.

On what basis do they know that you, the Keeper, are also the driver? Unless you have blabbed that fact to them, they don’t know. There is no legal obligation on  the known Keeper to identify the unknown (to them) driver to an unregulated private parking firm.

If there is no period of parking noted then they cannot hold the Keeper liable. Also, without a period of parking of more than the minimum consideration period, there is no no evidence of a contract being formed.

I thought removing the time stamp would make the letter untraceable in case any friends from District were browsing. There is a single time behind the redaction.

No period of parking stated on the "PCN", as per screenshots.

I'll suggest they kick rocks and see how that goes.
