I would really appreciate advice for what I consider a bogus PCN issued to me which is starting to cause me stress as I have been sent a Final Notice before formal legal proceedings. I like a few others posting on this forum have received a delayed PCN for parking outside Kelly's Storage LU2 9JF near Luton airport which seems to be an orchestrated parking trap.

I received a Notice to Keeper from Universal Parking Enforcement Ltd on 30/01/2025 which was dated 22/01/2025, 30 days after the supposed parking contravention on 22/12/2024. I immediately appealed this notice through their website on the grounds the PCN was issued after 14 days and there was no clear signage where the alleged contravention occurred. I received no response either by post or email and thought the matter dropped until I received an Outstanding Parking Charge Notice from TNC Collections in April (17/04/2025).

I called TNC collections to explain I had not received a response to my appeal and they claimed my appeal was rejected via email on the 14th March 2025. I have not been able to find any evidence of this email response in any of my email folders and asked for evidence of the rejection being sent for which TCN have said they will send me on two occasions now but I still have not received.

Unfortunately I have no record of my actual appeal as this was sent through the Universal Parking website.  I only have a screen shot of confirmation of my appeal on the website (I did not receive any email confirmation of my appeal which I had presumed would be matter of course). 

The supporting evidence on the Universal Parking Ltd website consisted of low resolution pictures of a small laminated temporary parking sign cable tied to a post which I have identified on Google Earth as being located across from the site facing away from where my car. Another image shows a small unlit sign on a wall close to my vehicle but facing at angle not in line of sight of driver. However the picture does somewhat clearly show the drivers face.

To my knowledge my appeal does not state who the driver of the car was but I have not seen my appeal since it was written.

Any advice would be gratefully received.

Subject: Parking Charge Notice ...– Formal Dispute

Dear Sir/Madam,

I am the registered keeper of vehicle ... and write in relation to the above Parking Charge Notice. I deny any debt to your company.

1.   Non-compliance with PoFA 2012
The Notice to Keeper was issued more than 14 days after the alleged contravention (dated 22/01/2025 for an event on 22/12/2024). This fails to comply with Schedule 4 of the Protection of Freedoms Act 2012 and therefore no keeper liability can arise.

2.   Appeal mishandling
I submitted a timely appeal through your website on receipt of the NtK. I received no rejection, no independent appeal option, and no evidence of any such correspondence being sent. This is a clear breach of both statutory guidance and fair process.

3.   Inadequate signage
The signage at the site is insufficient, unlit, and not positioned in such a way as to form a contract with drivers. It fails the test of transparency and prominence required under the Consumer Rights Act 2015.

In light of the above, this charge is not valid and must be cancelled. Any continued pursuit, including referral to debt collectors, will be reported as harassment. I also reserve the right to complain to the DVLA and the relevant trade association for misuse of my data.

Please confirm in writing that this matter is now closed.

As long as you have not identified the driver, you have nothing to worry about. Stop trying to communicate with powerless debt collectors. All they can do is try and intimidate the low-hanging fruit on the gullible tree to pay up out of ignorance and fear.

When you receive an actual Letter of Claim (LoC) come back and we can advise on the next steps. Yours is not the first case regarding this location we have dealt with over the years.
