PCN Not my Fault
« on: »
Long story, this has been going on since August.
I parked in a car park in August in Worksop for about half an hour. The machine didn't take card so I had to call an automated system.
I firstly called from my phone but their system wouldn't recognise that I was selecting numbers as requested. I then called from my son's phone, gave personal details, bank details and requested parking for one hour. I then received a text after the call asking me to confirm my number plate which I did immediately at 15.03. I then received a message saying you parking hasn't been booked but then after that I received a message saying thank you for updating your vehicle details so I took this as a delay in the system.
Some time after I received a PCN stating I hadn't paid for parking. I checked my bank account and they had taken 0.01p instead of £1 for the hour.
I appealed and sent 3 pieces of evidence because that's all their system would allow me to upload. I then received an email asking for the phone numbers used but they didn't give me an email address or phone number to provide it. The email addressed they had contacted me on was a no-reply.
I went to POPLA who declined that appeal because they said I was parked for 12 minutes before paying for parking and I had to pay within 10 minutes. The reason I didn't pay within 10 minutes was because I spent all that time trying to pay for parking through their automated system. The call where I thought I'd paid for parking was 6 minutes 40 seconds long.
I went to BPA and they said they couldn't help and gave me a link to the parking company's complaints page.
I went over it all again in a complaint to the parking company and they said again that they asked for the phone numbers and didn't get them, I again told them they didn't give me any contact details. I send them all evidence again and they wrote back saying there was nothing wrong with their system and that they didn't receive the text message until 15.16 when I sent it at 15.03. Them getting the text delayed is not my fault and I did have a confirmation text stating my vehicle details had been updated. I told them to take me to court and they simply replied with see previous decision and now refuse to talk to me about it.
What can I do now? Do I wait for them to take me to court? I can't afford for my credit rating to be affected by this and £100 is a lot of money to me as I'm a single parent in privately rented accommodation.
It doesn't matter who I go to, nobody is looking at the evidence correctly.
I have evidence of all calls, texts and the fact they only took 0.01p so had my bank details to take the payment.
