Hey,

I tried to appeal to a PCN from GXS but the adjudicator rejected the appeal on 21/07/23.
Yesterday (15/08/23), I received a final reminder letter from GXS:

https://drive.google.com/file/d/1vQuvW0ciO3...iew?usp=sharing

As you can see, it says a Notice to Keeper was issued on [blank]. I never received this, which should have come through the post. Perhaps this is why it is blank.

Also, I received the letter yesterday, and I can't find a Royal Mail mark indicating when it was actually posted, as on the letter it said the 4th, but I received it yesterday, which doesn't make sense as they said I have 7 days from the 4th to pay. So why did I only receive the letter yesterday?

I sent them an email, which they didn't understand so I had to send them this:

Hi,

Re: Parking Charge Notice Number 106977 (Vehicle: GY72ZSU)

Thank you for taking the time to reply to my email. I think you were confused with my email.

I would be grateful if you could re-read my email and respond accordingly as I have no idea how your response relates to my questions. If you think it does, please indicate how they connect and I may understand. I am autistic and this can affect how process information.

I'm asking for notice to the keeper not PCN, from my understanding PCN is parking charge notice. Wouldn't the acronym for notice to keeper be NtK not PCN? If you can explain how they're the same, in terms of your services that would be great. In the letter you specifically say you sent a notice to keeper NOT PCN. Please refer to your letter.

Lastly, as you have not responded to my email I've included it here for reference. I've also highlighted the areas of importance. Hopefully this helps with your reading comprehension.

Hi,

I received a letter but you never sent me the notice to keeper, which is probably why the letter doesn't include this. Please see attached.

I would like you to send me to notice to keeper that should be a charge of £100 as I haven't received this. Furthermore, I can't pay for the PCN online so why send a letter asking me to pay but not letting me do so.

Lastly, I received the letter today. The letter was posted on the 4th and you gave me 7 days to pay from that date. It doesn't make make sense that I only received the letter today. Please explain.

This is your reply:

Further to your email, A PCN was affixed to the vehicle concerned, the account has now been passed to Trace
Debt Recovery, they will if not already contact you, it is they that you must communicte with.
I have attached images of the vehicle with the PCN attached to it.

Hopefully by putting my email with your response side by side you can see how the two do not connect. Let me know if it doesn't make sense and provide me with feedback in  how I can help you comprehend my questions.

Also, why send me this letter asking to pay when I can't pay for it once I received the letter. I'm struggling to understand the logic here

Any advice would be awesome! I don't know what is going on here but things are not adding up.

The Google Drive link you have included doesn't seem to work for me.

Before we get into the back and forth between you and GXS we need to clarify what has happened so far.
  • A PCN was issued, affixed to the windscreen of the car. Do you have this, and if so, can we see it?
  • You submitted an appeal. What was the exact wording of this appeal?
  • You say 'the adjudicator' rejected the appeal - presumably you mean GXS, or have you already appealed to the IAS? Let's see the rejection notice
