Private Land Parking fine Gladstone Solicitors
« on: »
I had received a PCN from CPM UK car park management dated the 28th October 2023 for 3:06 on a private car park for Southern Housing (which isn't stated on any letters).  The letter before action states a different time aa so do the photos.
Its like it took them 20 mins to fill out the car details.  As the registrared keeper I ignored it as it was also titled Mrs and am not married.  I received debt collectors letters which I ignored.  Now I am getting letters from the solicitors stating that they could possibly take legal action.  I have an issue as on the final warning the time is different to the first PCN. I asked for photos which they have sent but the sign is unreadable.  My name is on the V5 which is up to date now and the DVLA have apologised due to their error. It look like they have changed the times on the photos.  Please can you advise.  I haven't named the driver.

I hope the links will take you to the paper work

I don't see any "letter before action" in there. Only a response to your communication with Gladstones. The "final chance before action" is not a Letter of Claim (Loc) and it is unlikely that it would come from CPM. They would use Gladstones or some other bottom-dwelling bulk litigation company to do that.

You mention that "my name is now up to date on the V5C". Was it not correct at the time of the alleged parking event? If there is even a remote possibility that CPM or Gladstones hold two possible addresses for you, you must send an email to the DPOs of both companies, instructing them to update their records with your current address for service and for them to erase your old address and to confirm when they have done so.

Simply updating your v5C after you have received an NtK does not mean anything to the PPC because they are only allowed a single bite at the DVLA cherry for your data. You do not want them holding an old address when you may miss a vital letter and end up with a CCJ by default.

We also need a bit more information for context. You show a permit in your photos. Why was the vehicle parked at the location? Is that where you live? Is the permit issued by CPM or via the management company or landlord?

My apologies I have a learning disability and jump to parts and forget others.

I received a letter before action as I wasn't the driver.

My name and address on the V5 is correct just the title was wrong so I didn't open the letters as am not married.  I just saw it as junk mail.   They stated the PCN was due to no permit on display but the photo of the sign post isn't visible and it's very dark.  The post aren't clear about visitors and there is more than one entrance and exit to the property (looked at it on Google).  The road that the property is on is a double yellow so can't park no where if you had too.  I done some reading and Southern Housing are the ones to issue a permit not CPM. The permit that they took a photo of is to dump rubbish at the Croydon dump which was on the car when purchased.  I hope I have given you the correct information

You are under no legal obligation to identify the driver. However, if you were not the driver, then you can simply say so.

You showed a picture of a permit which is for Croydon Recycling Centre. Is that one of the photos provided in the operators evidence pack? I don't understand why a picture of that irrelevant permit is shown.

You have not answered the other part of my question... "Why was the vehicle parked at the location? Is that where you live? Is the permit issued by CPM or via the management company or landlord?"

Sorry I didn't answer all the questions. No it's not where I live. The permits are issued by the housing not the parking company.  As am not the driver I am assuming that they went to visit a person who lives there.

The driver doesn't live in London.

So, the driver was visiting someone at the location. What is the procedure for visitors to obtain a permit to park there? Was the driver not made aware of the parking terms by the person they were visiting?

As far as am aware yes they was visiting.  I checked on the housing website and the tenants of the building can obtain a visiting permit on their website not the company who issued the PNC.  I am assuming the driver wasn't aware of the permits situation as from the the photos you would need a flash light to read the signs at 3am . An am not sure if the driver was made aware of the parking terms as I don't know the person or the property that the car was parked on
