G24 Parking PCN Exceed Max Stay Weymouth Retail Park

Fact - Upon entering  the car park, the driver found a space, parked up, and went for their meeting and it is relevant in this case to say this was within the Costa Coffee parking area.  The meeting ran over, and when they left the car park they exceeded the maximum stay of 180 minutes / 3 hours.  The parking incident was 30.09.24 and the date of the notice to keeper was 10.10.24, the letter arrived on 19.10.24.  Whilst the letter was late, there is not time stamp on the envelope from Royal Mail by Whistle.  I am the registered keeper and received the letter through the post. 

1) I am unsure how I could prove the letter breached PFOA 2012 as clearly not sent by 11/10 (taking into account 2 working days rule so it is delivered within the parking period) when it is not franked. It was received on 19/10/24,
2) The letter / notice appears to breach the PFOA 2012 as it states they will assume I am the driver if I do not name the driver and address within the 28 day period.  I have seen G24 letter templates that have the correct wording on, this one appears to be an older template.
3) The letter refers to the terms and conditions not agreed with, the max duration, and the sum of £100 is payable.  They state in the notice to keeper that the terms and conditions were clearly displayed at the entrance to, and in prominent places within, the car park.  I have taken photos that show no signs at the entrance to the main site by the ANPR cameras, no signs on the entrance to McDonalds or costa coffee.  I have attached signs within the areas of parking within McDonalds and costa coffee.  SO according to the notice, the signage contradicts the details of the claim in the notice.
4) The signs do not appear to be visible to the driver, they are very high, not at the entrance to each individual store area, they clearly show the max stay duration, but the £100 charge is not visible.
5) There is also a contradictory costa coffee sign that shows a max stay duration but mentions nothing about a fee, and this is the most visible sign within the costa coffee parking area and faces the correct way.  The G24 sign next to it is higher and faces McDonalds so is very hard to see.

Hopefully the link allows you to see the notice and some of the photos I have of the entrance and signs.  I also have a video showing the route into the site, entrance to costa coffee and McDonalds to show no signs on entrance to those subsections of the site.

6) My intention it to contest the charge.  I would be grateful for views on the above points, any advice on format of letter, and any other points I should raise.  I am aware this company use IPC and not BPA / POPLA so they are likley to deny my appeal.

If those are your own photos, make sure you keep the metadata to show the date and time they were taken. In fact, you can get an app for your phone that will superimpose on the photos the date na time as a date-stamp. Useful if this ever gets as far as a claim in the county court.

As for the dates, their Notice to Keeper (NtK) is deemed to have been "given" within the 14 days, irrespective of the actual date you received it, unless you can evidence otherwise. It was "issued" on Thursday 10th October which means it was deemed given on Monday 14th October. Monday 30th September, the day of the alleged contravention is day "0". Day 14 therefore was Monday 14th October, just in time, if they are relying on PoFA.

However, as you have noted, the wording in their NtK is not compliant with PoFA and stating that "we may assume you to be the driver" is simply not allowed. They have failed to fully comply with ALL the requirements of PoFA to be able to hold the Keeper liable for the charge.

Not that that will make much difference to G24 who are an IPC operator. They will reject any appeal and you are very unlikely to persuade the kangaroo court that is the IAS either. Personally, I wouldn't waste my time trying to appeal but others will have different opinions.

The only way this will be resolved is if/when it is heard in the ultimate dispute resolution service, the small claims track of the county court. I doubt it would ever reach a hearing stage and is most likely to be thrown out or discontinued. Even if it did make to a hearing, it has a very good chance of being defended successfully.

If you are up to the fight and feel aggrieved enough about this scam, then come back if/when they send a Letter of Claim (LoC). In the meantime, either try and get Costa to get it cancelled or just ignore any and all reminders and debt collector letters.

The debt collectors are powerless and can be safely ignored. Their only purpose is to try and scare the low-hanging fruit on the gullible tree to capitulate after they see threats of litigation and scary words like "CCJ" and "bailiff", none of which can occur without losing in court and then failing to pay the judgment amount within 28 days.

Hi,

Just to update. I visited Costa Coffee who spoke to their G24 contact. They told me to appeal and submit any receipts to show purchases made in Costa. A waste of time. I appealed to G24 and got a largely generic response denying my appeal. 

In the meantime I was hunting for the site owner and found them. I appealed to the site owners, they spoke with G24 and after about 4 weeks they agreed to remove the PCN. It took a while, and determination but I got there!

Thanks for the advice. I read lots of cases on here, I find this website fascinating. Keep up the good work.   :)
