Hi all,
First time posting here, and I’d appreciate some advice please.

I’ve received by post a PCN for overstaying by 19 minutes at Morrisons car park, Stamford Hill, London N16 5TB. The car park offers 2 hours of free parking.

I am the registered keeper, but was not the driver at the time. My wife was driving. She is a Blue Badge holder, however she did not register the vehicle with a staff member as stated on the signage (she was unaware of this requirement).

There is no Morrisons receipt.

My question is:
Would it be better to appeal based on the Blue Badge/disability, or on the fact that I was not the driver?

Any guidance on how best to proceed would be much appreciated.
Also, if someone would be willing to help draft an initial appeal, that would be greatly appreciated.

Morrisons are pretty good at getting these cancelled - try https://www.morrisons.com/help/form/contact-us/car-park/car-parking-charges/i-have-a-car-parking-charge  although it does say they want a receipt.  Could you evidence shopping there by other means, e.g. bank transaction?

The POFA requirement for invitation to pay or nominate the driver is missing from the NTK, but this is unlikely to sway wither ECP or POPLA, but no harm in trying.

Thanks for the advice. I’ve contacted Morrisons, and I’m waiting to hear back from them. Hopefully, they’ll respond before the 14-day discounted period ends.

The notice to keeper is not PoFA compliant so they cannot use PoFA to hold the keeper liable and they have no idea who the driver was.
