Hello, hopefully I've included all the relevant information.

The driver parked in a bay marked "Budgens customers only" between the times 16:26:11 and left 16:33:53 (shown on the PCN). During this time the driver said they think they checked their bank balance at the ATM which is attached to the shop/petrol station but can't remember if it was on a different day, they entered the nearby fish and chip shop briefly, then got in the car and left.

My dad is the registered keeper of the vehicle. I'm getting advice on his behalf.

I was under the impression there was a grace period of 10 minutes that a driver could potentially observe the signage and choose to leave or not, I'm not sure about that though.

Think about it for a minute… What evidence if any at all do they have that the driver was not a patron of the store. This just goes to show how stupid and thieving these vermin are.

Remember, the burden of proof is on the operator to prove their allegation. Not for the appellant to prove otherwise.

The allegation is “parking for patrons whilst on the premises only”. It does not allege that the driver did not enter the VRM into any “terminal”. They have to prove their allegation. They can’t.

Another point, I notice the sign that can be seen in the photo on the notice looks somewhat different in terms of layout to the one you have attached a photo of. Do you have a photo of that sign?

Obviously he's not going to pay it and I've told him the only point he'd have to pay anything is if a judge told him to.

For what it’s worth, your dad will be appealing it (or you will, in his name). We’ll give you something to use when you’ve shown the sign mentioned above.

Any appeal is going to be rejected but it puts them on notice that they are not dealing with low-hanging fruit on the gullible tree. An appeal to the IAS is debatable. Personally, I don’t think it’s even worth the effort appealing to this kangaroo court. Others on here will disagree. We have, on the very rare occasion, seen a successful IAS appeal but they’re as rare as hens teeth.

The next phase would be the useless debt collector letters which can all be safely ignored. Debt collectors are powerless to do anything except try and scare the gullible into paying.

Eventually, they may issue a Letter of Claim before issuing a claim in the county court. This is another part of their modus operandi. In the vast majority of cases, they eventually discontinue before any hearing and move on in search of even lower hanging fruit.

Compare the two signs. The one you have taken (make sure you have the meta data to show when it was taken) and the one they have sent you. Notice a key difference?

My dad said he was sent that first sign over Facebook by a family member, so it can be disregarded.

The 2nd sign is one I took myself so I know it's accurate.
