Euro Car Parks - Sainsburys - Parent and Toddler Bay

Hi all new here apologies for any mistakes in advance.

Ill keep it brief.

Parked in Sainsburys in Parent and Todler Bay - partner and kid went inside driver remained in the vehicle.

Attendant came over said cant park there, driver explained the above.

Attendant said okay walked off - then sneakily prints out a PCN and attempts to stick it to the vehicle.

Driver then drives off after being aware of the attendants intention.

NTK in the post to RK. No evidence available online on ECP website.

No appeal made.

Sainsburys claiming they do not have facility to cancel PCN.

Any information is welcome, prefer to deal with the situation now rather than letting letters pile up.

This looks like a further notice as discount period as no longer applicable?
Have you appealed to Sainsbury’s head office without naming the driver.
If as you say you were parked in compliance why did the warden only wait 5 seconds and why did you need to drive off without the toddler on board. What age on the signs is a toddler you need to show these,

You say there was a toddler present.
The warden says there was not!

Is the partner prepared to witness they were present with toddler?

Does that fact that the OP left before the NtD could be given hold any water? Have ECP used the 'wrong' NtK?

The Dropbox link doesn't appear to be working, so we'll need to see the NtK to check. Driving away from an attendant issuing a notice is not a magic bullet, but it does mean one wasn't served on the driver. They'd therefore need to go straight to a Notice to Keeper that's compliant with paragraph 9 of PoFA.

A more straightforward line of argument, which can be used alongside any PoFA argument, is that the bay was being used correctly by two parents with a toddler. That one parent remained in the vehicle wouldn't appear to alter that fact.
