NPC - not parking wholly within a parked bay
« on: »
Hello

The local gym has recently given NPC the responsibility of controlling the car park.

The driver (family member) has told me that there was limited parking and they had to enter the parking space on an awkward angle because of the positioning of the the 2 cars parked alongside the space. Without entering the space as such they wouldn't have been able to park.

please can someone help?

Before we get onto anything else, have you spoken to the gym management yet? If not, as the ones who seemingly contracted the parking company to manage the car park on their behalf, this would be a wise first step.

I have had a similar one before and they said they are reluctant to 'sort' them for people any more as they are paying the fines themselves so I have to address the matter with the parking firm myself. Do you think what I have been told is correct or it is a simple matter of them cancelling it themselves.

The short answer is 'don't know' - without seeing the terms of the gym's agreement with NPC. Some of them do have rather unusual clauses in them that rather seem like the tail wagging the dog. Trying costs you nothing, though, and the prospect of them losing a loyal customer over the matter might sway them (even more so if other family members are alos members who will also find an alternative gym if they don't cancel the charge, for example).

1/ They are invoices, only a court can fine you (since the Magna Carta), even the police, councils, other statutory bodies can only issue penalties.
2/ Tough, they entered a contract, of their own volition, they put themselves in that position by not doing their due diligence before signing it, lean on them and make a credible threat to move if they don't sort it out (1-2 months of lost membership would cover the invoice). Their bed, they have to lie in it - and if they lie with dogs they will catch the fleas. Enough get annoyed they may bin off these parasites.
