ECP PCN but sold vehicle before

I sold my van through FB on 18/3.  The buyer collected but did not leave their address on my part of the V5.  I messaged them but received no reply.  I received a PCN for a breach on 1/4 and I sent a photo of this to the buyer via FB.  Still no reply. I notified ECP that I wasn’t the driver and supplied his name and district but unable to provide address.  I notified DVLA about the transfer which they dated from 18/3.  I have now received a final notification letter.  I have sent a photo of this to the buyer via FB but again no reply.

Could you advise, please?

how did you notify dvla? online? what address did you give dvla for the new keeper?

you've just learnt a lesson in checking the buyers details before selling.
I ask for proof of identity now, photo drivers licence etc.

Yep, won’t make that mistake again.  Notified DVLA by phone and email. Do not have his address and they said send what you have.

Do you have written confirmation that you were no longer the Keeper from 18/3 from the DVLA?

Either way, even if you did nothing and they eventually issued a county court claim, as long as you follow the advice given here, you would not be paying a penny to ECP and the clam would eventually be struck out or discontinued.

So send a formal complaint to ECP together with the evidence that you were no longer the Keeper of the vehicle on the date of the alleged contravention. Here's a suggested complaint you can send to them:

Subject: Final Position – Parking Charge Notice [Ref: xxxxx]

Dear Sir or Madam,

This is my final correspondence regarding the above Parking Charge Notice issued in relation to vehicle registration [ABC123].

As you have already been informed, the vehicle in question was sold on 18 March 2025. I have since received formal written confirmation from the DVLA that I ceased to be the registered keeper from that date. A road tax refund has also been processed accordingly.

The alleged parking event took place on 1 April 2025, by which time I was no longer the registered keeper and had no control over the vehicle. You have been provided with the name and general location of the new keeper, who took possession of the vehicle on 18 March. That individual failed to complete their section of the V5C and has ignored all subsequent messages. I do not and cannot know who was driving the vehicle on the date in question.

As such, I am neither liable as keeper nor as driver, and you are prohibited from seeking to transfer liability under Schedule 4 of the Protection of Freedoms Act 2012. The statutory conditions for keeper liability have not been met.

Let me be clear:

• Any further contact from Euro Car Parks or any third party acting on your behalf concerning this matter will be treated as harassment, in breach of the Protection from Harassment Act 1997.
• Continued processing of my personal data constitutes a breach of the UK GDPR and Data Protection Act 2018.
• You have no lawful basis to continue pursuing me or retaining my data.

If I receive any further communication relating to this PCN, I will pursue a complaint to the ICO, the DVLA, and reserve the right to seek injunctive relief and damages in the County Court.

Erase my data with immediate effect and confirm that this charge has been withdrawn.
