Hi All,
Looking for some advice please.

I recieved the attached claim via the HM Courts from the snakes that are DCB Legal.
After some internet research I found myself here, and followed the good advice given to others in my situation.
(primarily this one - https://www.ftla.uk/private-parking-tickets/court-documents-received/)

I downloaded the defence documentation template and filled in accordingly (also attached), then emailed it to "claimresponses.cnbc@justice.gov.uk" and cc'd myself as advised elsewhere on this forum.
(fyi I did the Acknowledgment of service via the MoneyClaim website immediately prior to the defence email)
The court acknowledged receipt of my defence as attached.

Plenty of time lapesd and I hoped that the time had run out for DCB Legal to persue the claim but unfortunately they seem to have served notice to proceed with the claim right at the last minute (I guess this may be another one of their underhand tactics).
Attached is their response and N180.

The court have sent a letter with an N180 form for me to fill out and return by this friday (13th June)
Last attachment.

I trust this case will follow a similar course to this forum topic - https://www.ftla.uk/private-parking-tickets/please-help-received-a-claim-form-from-court/

Note, I have just noticed that I can only upload 4 attachments per post, so a 2/3 additional posts will be needed to upload all of the bits.

Thanks in advance.

Well done. Everything correct so far and the correct version of the defence has been used. DCB Legal, for some reason, fail to put a cause of action in their PoC for ParkingEye claims. It just makes it a bit more outside the rules and thus easier to request a strike out, hence the difference between the CPR 16.4 and the CPR 16.4(1)(a) defences.

As you've obviously done your research, you will know that any claim issued by DCB Legal will be discontinued as long as any defence, even if just a nursery rhyme, will end up as a discontinuation. If ParkingEye believes their claim stood any chance of success in court, they would issue the claim through their in-house litigation team rather than had it over to the incompetents at DCB Legal.

As long as you have now completed your N180 DQ, you can email it as soon as your MCOL history shows that yours has been sent.

Next will be your mediation call where you simply offer £0.

Hi b789,

Thanks for replying.
I'm glad to hear I have done things correctly.

I will be completing the N180 form this evening.

Hi All,
Thanks for the help so-far.

Had my mediation call yesterday where via the mediator DCB Legal offered a reduced fee, and in return I offered £0 as advised.

The mediator fed that back to DCB and returned with a second call stating that DCB are now going to proceed with the claim, and that I should wait 2-3 weeks for the next part of the process.

I trust that this is all part of the normal song and dance.

All normal. The claim will now be allocated to your local county court. Once that has happened, a judge will issue "directions" that will include a hearing date, a deadline for the claimant to pay the £27 trial fee and a deadline for both parties to submit their documents.

If DCB Legal do not issue an N279 Notice of Discontinuation (NoD) just before the trail fee deadline, I will eat my hat.
