Hello,
I received a parking fine where the pay meter in the car park was broken saying 'out of order'. I have a photo of this. I looked at the signage and I'm sure it gave no other indication of how to pay so I did leave the car there for approx 2 hours.
I appealed the fine with a photo I took of the faulty meter. I didn't take a photo of the signage though - Britannia parking have rejected the appeal and are saying:
'The Parking Charge was issued to the vehicle because a valid ticket was not purchased. It is the
driver's responsibility to ensure that they have read and understood the terms and conditions for
using the car park.
Please be informed that Britannia Parking provides multiple payment methods at this site to allow
the car park user to purchase a valid parking ticket for their stay.
The signage clearly shows that payment can also be made via PayByPhone which is available in
the car park.'
I'm sure the signage just said 'pay by metre' and had the name of the council on it, not Britannia parking and no mention of pay by phone. I have that app and would have used it, if it had been indicated to me. I can't go back to the car park to take photos though, it's too far away. Do you think I can win my appeal? The next stage they say is to make an appeal to POPLA. They say I cannot appeal to the ombundsman: "we have not chosen to participate in their alternative dispute resolution service. As such should you wish to appeal then you must do so to POPLA".
