Do you have a copy of the original PCN?

Has the Claimant provided you with their Witness Statement?

Did you ever appeal the original PCN?

Hello

No - dont have anything original from them.

Where would i find my witness statement from them? does it get emailed?

Ive moved house since all this has happened so im getting all my post redirected which adds about a week to already slow mail.

Didnt appeal the originals at the time.

Does that hurt my case?

ok - so I would quickly prepare a short Witness Statement and submit it.

They will almost certainly discontinue.

Something short like;

1. I am the named defendant.

2. I have no recollection of the PCN which the Claimant says was issued at the material time.

3. The Particulars of Claim are scant and provide no real clue as to what is actually being claimed.

4. The Claimant has provided no evidence / witness statement to me in the manner which was specified in the prior order.

5. Not withstanding the above, the Claimant has never demonstrated that I was the vehicle driver.

6. That I cannot plead the alternative since the Notice to Keeper was never served on me.

7. That in the absence of adequate POC, this is a skeleton Witness Statement.



Then add all the bits mentioned in the Court Order.

Submit this by 4pm tomorrow.

The details are on page 3 and 4.

Thanks for the help.

Ive sent off the statement.

I'll report back when i know for sure if they have discontinued.

Perfect.

It was just a case of covering your arse in case the Claimant submitted something last minute and then tried to imply that you had screwed up.
