Hello All,

I recently received two PCNs via Parkingeye from the same retail car park in Colindale, London:


  • First one - Date of Event 14/09/24 - Date Issued 14/10/24.
  • Second one - Date of Event 12/10/24 - Date Issued 16/10/24.


The first one was issued after 30 days and on the reverse there is no paragraph for Protection of Freedoms Act. The second one was issued after 4 days and does have the Protection of Freedoms Act paragraph.



Am I correct that with POFA they need notify me within 28 days and without POFA they have unlimited time? If so, it seems unfair that they removed the POFA para in the first PCN. What is the point of POFA if they can just remove it and give themselves unlimited time?



Do I have any grounds of for disputing the first PCN issued after 30 days? Thanks.

PoFA has nothing to do with whether the PCN is valid. PoFA is all about being to transfer liability from the unknown driver to the known Keeper.

If a PPC decides not to rely on PoFA, then only the driver can be liable. The only way they can know who the driver is, is if the Keeper blabs it to them, intentionally or otherwise.

If the PPC wants the ability to transfer the liability from the unknown driver to the known keeper, then they have to comply with all the requirements of PoFA, of which the date of issuing the NtK, is only one element.

So, in your case, which PPC? Double check that the "first one" that you are looking at is not a "Reminder" notice. Its is only a requirement of PoFA that the initial NtK complies with all the requirements. If you are looking at a ParkingEye NtK, they will have the PoFA notice on the back but on the reminder, it is not there.

So, if you want advice on how to proceed with both PCNs, pease read this thread and then show us the PCNs you have received.

Thank you for reply b789. I did a little more research into PoFA and have a better understanding now.

This is the first PCN dated 14/10/24. It was issued after 30 days but is not a reminder as far as I can tell. I'm assuming there is no PoFA because they issued it after the NtK deadline?





This is the second PCN dated 16/10/24.




If in both cases I was not the driver - as registered keeper I would be legally liable for payment of the PoFA PCN - but not for the non-PoFA PCN. Is that correct?

Yes… but even the PoFA one, there is a technicality with PoFA. See if you can find any “invitation”, or any synonym of the word, for the Keeper to pay the charge.

Have a read of PoFA 9(2)(e)(i) to try and understand why.

The non PoFA one is a “hens tooth”. Quite rare for ParkingEye. Maybe they only issue PoFA ones on days with the letter “T” in it at that location… or something.
