APCOA Charge - James Paget Hospital - Gorleston

Hi there,

A unique problem potentially. Owner has received a PCN for parking at local hospital but the charge was paid.

The issue i believe is the driver, who hasnt been named, paid using a Currensea debit card which works different to a normal debit card, as in such it takes money via a direct debit. The offence in question happened on the 7th July and payment taken on the 9th.

Also, this is a lease car and we have a note with dates today's date (28th July) advising of said contravention that happened on the 7th July, so this is over the 14 day ruling anyway. Or is the law different on lease cars?

Should we contact APCOA and advise the payment was made on the day first and if unsuccessful go with the incorrect PCN?

Firstly, APCOA don’t “do” court. So you can ignore everything if you want to, unless they change their modus operandi, so it’s not guaranteed.

Secondly, what exactly was your “note with today’s date” and from whom. In the case of leased/hired cars, the Notice to Keeper going to the leasing company, who respond and then the parking company needs to send a Notice to Hirer, which invariably fails in the requirements to transfer liability. However the 14 days only applies to the NtK, not to the NtH. There are time limits but I forget them for now.

So do not identify the driver, you haven’t and won’t, but post up what you’re talking about for us to see and advise please.

You wait for APCOA to send you a Notice to Hirer, now they have your details. Do not reply to the Notice to Keeper, which is not addressed to you, but presumably has been sent to you as a courtesy and for information.

When you receive the Notice to Hirer, it will not include the mandatory additional documentation described in https://www.legislation.gov.uk/ukpga/2012/9/schedule/4 paragraph 13, specifically

(a)a statement signed by or on behalf of the vehicle-hire firm to the effect that at the material time the vehicle was hired to a named person under a hire agreement;

(b)a copy of the hire agreement; and

(c)a copy of a statement of liability signed by the hirer under that hire agreement.

Plus the original Notice to Keeper, even though you actually have this anyway, because APCOA won't know this.
so you appeal then to your NtH stating that the driver has not been identified and that APCOA has not complied with the requirements of PoFA 2012 to transfer liability to the hirer of the vehicle.

The time limits are described in the legislation:

14 days to notify the registered keeper
28 days for the registered keeper to provide details of the hirer
21 days for the Notice to Hirer

which I believe ends up being 8 September at the latest.

Clearly another appeal point to the NtH will be that you paid for parking. You never know, APCOA might even accept your appeal.

So the lease hire sent this to acpoa, theyre obviously the owner and theyve sent it to our place of work

So I'm a little confused as they won't actually send anything directly to the "owner" (us as in lease holder), or will they?

No, the "third party authorisation letter" is rubbish. You need to tell the leasing company to follow the instructions on the NtK sent to them in a big box "how to transfer liability".

I think we've had cases like this with VW before which, if so, you should be able to find on the forum. I don't recall the outcome.

You could, presumably, appeal on the back of this stupid "third party" letter as you were originally planning to do because you paid. Just remember that in our experience APCOA won't take out a court claim, it might involve debt collectors if it rejects your appeal and you don't pay, but they can be ignored.

Apart from saying we are appealing is there anything else I should be mentioning?

I've just looked through all the payments and it went through 3 minutes before we left so they don't have a leg to stand by. I might even go to the hospital tomorrow and make a formal complaint, how many older people have they conned using this and they've just paid the fine!?

I can't understand much written in the email you posted, so if you are able to make sense of it, good luck! And it's inept because they refer to a "fine" which it isn't. Oh well.
