Application to set aside CCJ under CPR 13.2
« on: »
I fully paid a court claim from a private parking fine within the 14 days from the date of service.

Date of service 1st September 2025.

Paid 13th September.

Claimant admitted yesterday that they received it on the 15th.

Default judgement made on 16th September.

I was going to submit N244 application but unsure if it is better to get an order of consent first from the claimant.

Do I have to pay the £313 fee and wait to be reimbursed after the hearing or is there a way to postpone it until after the hearing.

If I obtain consent, is there a different application to submit?

I would be trying to seek consent (and on the basis of them paying the applicable fee) given the default judgement is by their own admission their fault. Given those circumstances it would seem unreasonable for them to resist.
