APCOA Parking PCN – No Stopping – Birmingham Aiport, Central Terminal Area

On the 11th August the driver drove to Birmingham Airport to drop off his/her family Inc their luggage.
On the 21st August the keeper received a PCN for "Dropping off or picking up outside designated areas"
The driver states that they have always in the past dropped off passengers and wasn't aware of this change, despite the signs and due to the rush did not pay attention to them.
The driver drove, the keeper received the notice and is now the one looking for advice if he/she should pay the charge. £100 with 28 days or £50 within 14 days from the date of the letter 18th August 2023.

MODIFY your post, the driver drove, the keeper received the notice and is now the one looking for advice!

There is no keeper liability, so you as keeper have no liability only the (unknown to them) driver, so best not to help them out.

"I am the registered keeper of the above vehicle and am in receipt of the PCN you issued. The land in question is subject to byelaws and as such it is not relevant land for the purpose of schedule 4 of the Protection of Freedoms Act 2012. Therefore there can be no hirer/keeper liability.

There is no legal requirement to identify the driver at the time and I will not be doing so.

I now expect you to confirm that no further action will be taken on this matter and that my personal details will be removed from your records"

They can either appeal online or post.

If online make sure they are careful to do so as the keeper and that they don't tick any boxes etc revealing who was driving.

If by post, standard first class post, asking for a free certificate of posting from the post office.

One last question
The PCN had the name and address of the registered keeper, do they respond as the "registered keeper" or their registered keeper name and address?

They need to provide their name and address, so that the parking company know that the person appealing is the same registered keeper that they wrote to.

Note the terminology on the notice, it is a Parking Charge Notice, not a Penalty Charge Notice.

Other than that it looks fine.
