APCOA Parking Charge Notice- 28 days elapsed

Hi,
The driver forgot to pay the railway station car parking amount of £2, on 2/12/24. The driver then travelled overseas the next day due to parental bereavement and returned on 17/1/25. In the meantime APCOA sends a parking charge notice dated 19/12/24. The 28 days had passed by the time the driver returned to the UK, and could not use the APCOA portal to appeal/pay/talk to station authorities.

On 3/2/2024 a letter arrives from ZZPS (a debt collector) demanding £155. The letter says 'A Supreme Court ruling, ParkingEye v Bevis, has confirmed that a parking Charge issues on private land is enforceable'.

If the driver had seen the notice within 28 days they would have paid the £50 that they could have paid within 14 days, although given Christmas post, it is unlikely the letter even arrived on time to pay the reduced rate.

Any advise as to what the driver should now do is greatly appreciated.

No one pays an APCOA PCN unless they are not here receiving advice or are just plain ignorant and don't know any better.

Please confirm whether the notice received is a Penalty Notice (PN) or a Parking Charge Notice (PCN).

As for ZZPS, you can safely ignore them and any other debt collector or Debt Recovery Agent (DRA). They are not a party to anything that involves the driver and are powerless to do anything except to scare the low-hanging fruit on the gullible tree into paying them. Ignore and please do not show us their rubbish letters.

If the Keeper (irrespective of wether they were the driver or not) can evidence that they were out of the country for the duration from receipt of the Notice to the 28 day limit, it can be appealed but using a specific section from the BPA/IPC Private Parking Single Code of Practice (PPSCoP).

APCOA PCNs or their fake PNs are easily dealt with as long as the known(to APCOA) Keeper does not blab the unknown drivers identity. APCOA never rely on PoFA to be able to transfer liability from the unknown driver to the known Keeper. There is no legal obligation on the known Keeper to identify the unknown driver to an unregulated private parking company.

At the end of the day, APCOA are benign and do not litigate so even if everything was ignored, in the end nothing will come of it.

So, can the Keeper evidence that they were away for the duration from two working days after the issue date of the Notice to day 28 after that? If so, please show us the Notice received, redacting personal details but leaving ALL dates and times visible.
