Today on 05 June 202, I received a letter from a debt recovery company relating to an a PCN issued by Smart Parking on 14 July 2023.

I have had no communication from Smart Parking at all relating to this - nothing at all, dating all the way back to the offence date. I tried to log an appeal through their system today based on that fact but the appeal was not registered by the system - I assume because it is so old and the time window for appeals closed a long time ago. The system message just said it didn't work and to try again in 24hrs. While trying to submit the appeal, I saw the photographic evidence and it is my car - I know that if this had been sent to me at the time, I would have just paid it. I am prepared to pay the original fine, but not the increased one.

Any advice how to proceed? Of course, I don't see any way to communicate with them and they won't respond to an appeal via their email address. I have convinced the debt collectors to extend my pay date by one week, so now only have a few days to try to sort this out.

If that is the first you are hearing about the matter after 2 years, the first thing you should do is get out your car's V5C document and check the name and address are correct.

It is too late to appeal, but this doesn't mean you should just pay. Debt collectors can be ignored, but, if you receive a 'Letter of Claim' from a law firm representing Smart, then come back for advice. Notices issued by Smart back in 2023 never complied with the requirements of Schedule 4 of the Protection of Freedoms Act, meaning they cannot recover the charges from the registered keeper of the vehicle.

Thank you so much for this information.

I sold the car last year and don't seem to have the V5C slip. However I do have the last tax reminder letter I got for that car, and the address is correct.

Could you clarify which requirements of Schedule 4 of the Protection of Freedoms Act Smart Parking was not compliant with in July 2023?

And also, is a 'Letter of Claim' the letter where they say they are going to pursue this through the court? What would be the action I could take at that point? I'd like to understand that better to help make my decisions.

Most of them. They didn't even try to comply with PoFA until recently.

Yes, it will generally say "Letter of Claim" at the top.

The contents of your response will depend on the contents of the Letter of Claim, but will generally involve you making clear that you dispute the claim, and asking dome clarifying questions. If you have a search on here for other cases you'll find some examples. After the Letter of Claim stage comes the actual claim, where you will file a defence.
