Yesterday, a driver attended the hospital for a medical appointment. The car park was completely full and so the driver circled the car park and surrounding area for over 10 minutes with no marked spaces becoming available. Numerous vehicles were parked at the ends of designated rows due to the lack of capacity and many were parked in places causing obstructions.
With no alternative available, the driver parked carefully at the end of a row, ensuring they were not causing any obstruction to traffic, pedestrians, or access routes. They then purchased and clearly displayed a valid parking ticket.
On returning to their vehicle, they found a PCN had been issued by UK Parking Control Ltd, despite the fact that:
• they had paid for parking in full
• There were no available marked spaces
• they parked considerately and safely
• Other vehicles parked in the same manner had not been issued notices
Other than trying with PALS and explaining the issues trying to park, can the driver appeal (although there is no way to appeal currently as there is a card saying how to appeal but no ref number whi9ch is needed on the website).
There are several drivers who are insured to drive this vehicle - not sure if I can say on here whether it was the keeper driving or not.
Hope someone can help, thank you
UPDATE: I have photos of where the driver parked - this is indicated by the red line on the car park image
cannot see how to upload these on here - so any help appreciated :-)
Guide:
Posting ImagesThe fact that the car park was full does not on its own constitute a ground of appeal (car park operators are not duty bound to provide unlimited spaces), but there are likely to be other avenues of appeal.
Wait for the notice in the post that they say has been issued. Anything on the back of either of those papers on image 2?
The white slip of paper was blank on the reverse - the card on the back says 'how to appeal a parking charge notice' but when I go to the website I can't do anything because they haven't issued me with a reference notice.
For completeness can you show us the back of the blue card?
I'd await the notice in the post. When it arrives, I'd be tempted to argue that the yellow windscreen sticker is a Notice to Driver (albeit a non-compliant one) - we can get into the specifics of that argument when you get something through the post.
Route One is 100% with PALS here and they are normally very good.
Thank you, I’m going to give this a try and if I’m struggling, I will ask for a bit more help on here once the fine has come through the post 😊
The note said that a parking charge notice had been issued against the vehicle and would arrive in the post
I'm in exactly the same position at a London Hospital and PALS directed me to follow the appeals process with the Parking Operator and if unsuccessful complain to the relevant health trust
