Good evening, I would appreciate some advice on a parking charge which appears to be an issue with not entering car reg into the computer in a leisure complex. I have been contacted by Gladstones so I went onto their website and filled a pre action protocol and also sent a message asking what it was about and apologising because I had thought their texts and calls were some kind of scam. I will attach correspondence.
Most recently Gladstones have sent the original documents from Minster Baywatch and said ‘Failure to make payment before the 21st March 2025 will result in legal proceedings being issued to recover the debt in full’
Advice would be much appreciated .

Please post the letter you got from Gladstones - is this a Letter of Claim?
Did you receive the original PCN and reminder - and are they addressed to your current address? Are you the registered keeper - car not leased or something? If you are reg keeper and this is the first you have heard of it you may be able to complain, which they will have to treat as an appeal. They will reject it of course, but it puts them on notice that you intend to defend it, not roll over and cough up. Their PCN is not POFA compliant so they can't transfer liability to the keeper anyway - hopefully you haven't identified the driver (even in passing by saying I parked or similar) in contact with Gladstones?
It's likely that Gladstones will move it to a court claim, but they will make a mess of the claim and you will be able to defend it with advice from here.

I think I received one of the letters. Yes I am the registered keeper. I haven’t identified the driver at all to Gladstones.
I haven’t found the letter from Gladstones but it is a letter before claim.
I would prefer to defend this but am not very knowledgeable on the subject.
The photos they have used are not time/date stamped and could be anywhere- can they really use these as evidence?
Are they even able to make a claim against me when there was never any money owed (no need to purchase a ticket) and they have no losses as a result of this?
Don't worry abut a claim from the utter incompetents at Gladstones. I will place money on the fact that they will issue a claim that fails to comply with CPR 16.4(1)(a) and any defence will highlight this and it is most likely going to be struck out at allocation stage.
When you receive the N1SDT Claim Form from the CNBC, show it to us. Only redact your personal info, the claim number and the MCOL password. Leave ALL dates showing and we can advise on the defence and how to deal with it.
