Excel PCN received

Hi

Hope someone can help.  I use this car park probably monthly and it has been free (Iceland Supermarket).  The PCN stated that I  did not purchase a ticket.  It shows I was there for 29 minutes.

I called the store and they said that Excel now own the car park.  I appealed the ticket and said it was a genuine error.  I then received their reply and they have rejected my appeal and the reason they have now given is...

'The signs at the car park make it clear that a maximum period of parking of 90 minutes is allowed for all vehicles
entering the car park, with the condition that no vehicle may return to the car park within 2 hours, giving clear notice
that the land is private property and that a Charge of £100 will be levied if vehicles enter and remain within the car
park outside of the Terms and Conditions displayed. It is the motorist's responsibility to ensure that they comply with
the Terms and Conditions of the car park; in this case the above detailed vehicle returned to the car park within 2
hours and therefore you became liable for the Charge advertised'

I am confused as they have given me two different reasons - any advice would be appreciated.

Please have a read o this thread and then post pictures of the Notice to Keeper (NtK).

Iceland have fobbed you off. Excel do not own the car park. They are contracted agents of the landowner or the landowners managing agent.

Plan A... email the CEO, Tarsem Dhaliwal, Tarsem.Dhaliwal@iceland.co.uk and explain the situation. You should get a response from their Resolutions Team saying that the PCN has been successfully cancelled.

He does not like his firms patrons being penalised by these vermin.

Just to say a massive 'Thank you'

After a few emails sent to their CEO as advised, I did get an email to say they have now cancelled the ticket and have issued the refund to me.

I really appreciate your help
