I probably know more about this location now than any other person. I lost in case 2240465350 after a lot of research and I decided the adjudicator was correct so I did not review. I no longer fight PCNs at this location as any driver who turns there has missed ample signage.

You won because Barnet changed parking contractor on 1 December and a secret source has told me they are in turmoil, my pending Barnet tribunal cases are all slowly being binned off. Happy days.

Haringey should not fetter their discretion by writing that they must treat you like everyone else and then they are 'unable' to cancel when they are, for now, the only people who can cancel. The whole point about discretion is that it leads to different outcomes based upon how compelling the personal circumstances are seen to be.

Management at Haringey now listen to me & me to them. If I raise a complaint about the wording they might cancel. My main concern in this though is to stop them writing that again in the future.

One adjudicator allowed a case on this basis, claiming to be unable when they weren't and another refused as he said it was mere semantics, they meant unwilling, so it all depends on the adjudicator).

You could win this because of the scaffolding as the sign required by law, at the biting point of the restriction, is virtually invisible. Other reinforcing warning signs may defeat this argument at the tribunal or they may not. The only way to find out is to go there if and probably when barnet reject a representation. Forget about the discount if you want to win.

Your request to parking was a valid one which they should have responded to, especially as it should be a 5 minute job to respond.

You haven't provided your numberplate, a copy of exactly what you wrote or a copy of the informal rejection (with only the name and address covered up).

Commonsense prevailed:

The contravention alleged in these proceedings is that this vehicle was parked adjacent to lowered footway. I agree with the council that this lowered section of footway is clearly discernible as such, and I therefore reject the appellant's submissions on that point, but it is not clear to me on its evidence that this section of footway is lowered for any of the purposes set out at S86 of The Traffic Management Act 2004: on the photographic evidence the vehicle is parked alongside a fence. I can see that there is a doorway within the fence, but the vehicle is not parked adjacent to that doorway. I infer that this section of footway, given its length, was originally lowered to provide vehicular access. That purpose now appears to be redundant. I am not satisfied that this lowered section of footway assists pedestrian, cycle or vehicular use when crossing or entering/leaving the carriageway. I find that the contravention has not been proved, and I allow the appeal.

I think this is simple ( in theory ). Your father was not served with the unpaid pcn otherwise he would have paid i and that is a complete defence. If he had received both, he would have queried it. The same happened to a client in Barnet except he didn't pay, consecutive pcn refs, the last digit is a check digit so ignore it and then the numbers are sequential.

The thing that most councils hate is bad publicity so if you have a local paper send them the story or try national newspapers.

I haven't had many Event Day PCNs recently, I used to get them every week (during the season) and this is because residents got to know, so now mostly visitors get caught and they aren't even going to the match.

I would expect the council to fail to prove something at the Appeal stage so forget about the discount if you want to fight as the council are most unlikely to cancel & I win half of my cases by going to Appeal (I win 85% overall, I have fought 2,000+ pcn in the last 7 years).

I would select the ground 'There was no contravention' (or similar wording) and then write that 'signs within the road did not notify me that the day in question was an Event Day, whatever that is, nor where that information was to be found. Please cancel the PCN.'

That is all. Don't veer off into other areas, keep it short and to the point, you only put yourself in it if you write more than that.

If you were loading/unloading or boarding/alighting a passneger who needed assistance that could be an exmeption so do come back if that was actually the case.
