Can I get advice for wording for the POPLA appeal ? What am I asking them Vs ECP appeal ?

Have received their standard appeal rejection. Please advise on the next steps, assume this is would be a POPLA appeal?

FYI the ECP online appeal form had reached its max characters, cutting off at the last paragraph, so had to cut down wordings where possible (but retained the overall jist etc)

Just for keeping in mind when helping the next poor soul! :)

Let’s see what comes. I am just a worried as the last time this happened to me Horizons sent me 100 odd letters in the post, from them/debt agency asking for money and with trumped up charges.

That then went to court - which I won. But it was a stressful ordeal. Happy to head to Court this time, just don’t want them bothering me at home by post or other!

However that time I 100% ignored and did not make an appeal, so hopefully different this time

Hi all,

I have received a PCN Letter from Euro Car Parks demanding £100 due to the driver allegedly overstaying the 3hr allotted time limit by 26 minutes when parked in "The Peel Centre" Bracknell Shopping Centre Carpark

I am the registered keeper of the vehicle and have its V5C doc

Hi All

On 1st November I visited Woodley Town Centre and Parked for 1hr at Crockhamwell Road Car Park, paying via Ringo app

I received a PCN for being 11min late, ie 1min over the grace period. It was my first time there and i took a wrong turn and got late walking back

My Appeal on these grounds was Rejected by Wokingham Council - is it worth taking my appeal to Tribunal with "1 min over the grace feels predatory" defense or whatever you advise?

Yes I was very surprised that we didn’t need to go to Tribunal.

Their wording was something to the tune of “we are accepting your appeal this time but don’t think this will help you next time” …lol

Update: Ealing Council cancelled the PCN on appeal

I won at Tribunal - Wokingham Council did not contest the Tribunal Appeal

Their comments :-

“Contravention did not occur, vehicles exit was largely clear, though it cannot be determined if they had space to clear the box fully, and no stationary vehicle prevented them from exiting. Driver stopped voluntarily within YBJ to allow vehicles to pass in front, this is not covered by the wording of the contravention.”

Strange that they rejected the initial appeal….

Sorry Think you misunderstood - My appeal was rejected by Wokingham Council. I had a letter of rejection from them.

I am now filing the case with Traffic Penalty Tribunal

What comments should I write on the case for Tribunal? Or just repeat the same appeal?

Thank you kindly for the responses as always. Yes she was indeed the Grey BMW who stopped to allow those 2 cars to turn into the side road

V5 in my name (insurance in hers). So I will make the response Wokingham Council as advised. Seems like are trying their 🍀

Also may I ask why Attachments function seems to be removed?

Hi

My Mrs has been hit with a PCN £70 by Wokingham Council for Stopping in a Yellow Box outside the Fire Station, observed for around 2 seconds - she said she had stopped out of courtesy to to let someone ahead turn into a sideroad on her side, had stopped for a second or so and was otherwise part of moving traffic

thanks - yes i was in the car as advised, and in process of moving on, having checked the sign up close and suspension dates were in effect etc

Please advise what i do from here - write an appeal or what process to follow please? i wish to fight this and take it all the way

hi all,

I have been hit with a £160 PCN while trying to park on Southall Broadway, by a overeager CEO & his Phone Camera!  :'(

Sitation:

I wanted to Park in a White-marked bay which was restriced 7am-7pm. It had struck 7pm so i found a suitable bay. I did then see yellow signs for "Parking Suspension" and proceeded to get out the car to check. I realised parking was Suspended on the day in question so immediately proceeded to get back in the car to move on. Turned on my engine and checked the rear etc - At this point like a Pouncing Tiger - a Cival Enforcement Officer coming from nowhere was seen snapping photos of my Car Reg from the pavement. As I was in the process of driving off in any case, I carried on driving as quickly as i could.

I feel this is predatory behaviour of Ealing Councils's CEO who literally pounced on my car snapping photos of me like a paparazzi and did not give any grace period or discretion, seeing that i had stopped to check the sign and was in the process of moving on after understanding the bay was temporarily suspended

Finally - the letter header (under "DO NOT IGNORE") is factually incorrect - the CEO had NOT "begun to prepare a PCN note for service", all they had done is take photos
