Private parking tickets / Notice of debt recovery / UK PARKING CONTROL
« on: April 29, 2026, 04:10:50 pm »
Hi, the driver unknowingly committed an offence on the 18/03/26. They unknowingly stayed over an hour at what they thought was a free 2 hour stay carpark no return within 2 hours however parking conditions state after 10pm maximum stay is 30 minutes. This was not made apparent to the driver as there were no signs stating this nearby and quite frankly does not make any sense as there are many places open until 11 in the same retail park. The driver was supposed to appeal this penalty however life got in the way, things got very busy and honestly forgot about it. The time to appeal has now passed and is now unsure on what to do. Can this still be appealed? Or does it have to go through to court once things are passed onto debt collectors

…and I told them that I do not wish to discuss a settlement, the claimant has a copy of my defence and I offer nothing, if they wish to go to court then let’s go

The mediator told me that the claimant believes my “defence is not acceptable” and they will proceed with a court hearing if a settlement is not reached

I don’t know if a default CCJ is the same as a judgement for claimant (in default) but this is what I received on the 13th of March

Sorry I got it mistaken, to confirm it was not a CCJ set aside but rather a Judgement for claimant (in default) which was sent by CNBC. This was sent to me on the 13th of March. After submitting my defence this was set aside on the 9th April. The claimant carried on with the original claim on the 12th May

Yes the claim was transferred to my local county court, Northampton county court to be specific, it was set aside by a judge after they had received my defence, which is the one you created for me earlier in the thread.

A few weeks later DCB Legal sent me a letter saying they want to proceed with the claim and that I would be sent a questionnaire

This questionnaire came last week and I’ve got until the 6th of June to fill it out and submit

Thanks a bunch, so I don’t need to send the letter back through post, and can just send the email?
