Private parking tickets / Property charge order from private parking CCJ
« on: December 01, 2025, 03:39:16 pm »
Good Afternoon All,

I have a question, I received a CCJ back in Aug 2024 which was a default in judgement.

I did not receive the initial claim from the Private parking company.

I tried to have this removed back in Dec 2024 but was unsuccessful. The judge in question claimed that the courts sent the paperwork even though there never any evidence of them doing so as I did not receive it.

The parking fine was from back in 2021, the judge even made a comment of how long it took for the company to bring it to court on the hearing and the amount of interest charges but refused to dismiss the case.

I now have a CCJ of £814 (mostly from interest added) on my credit file which is not a major issue as I have never owed a credit card or used any credit and my credit report shows I have never had any missed payments in the last 4 years.

I am looking to purchase a property and I am currently working with a broker that can secure me with an AIP without any issues.

The issue is since last year, the bailiffs has turned up at the property I live in and every time they turn up the alleged amount owed has increased, currently at about £3k.

My question is, if I purchased a property. What are the chances of them putting a charge order on this property as I am looking to purchase as a sole owner.

Does anyone know of any case of private parking companies putting a charge order on a property?

The CCJ will be active till Aug 2030.

Thanks 😊

I can't remember receiving any LoC, the only letter I received was the judgement in default letter.

I was out the country when the CCJ was applied and on my return I saw the default in judgement letter.

Hence the reason why I paid to have the judgement set aside.

My address is still the same, the only letter received was the default in judgement letter after the CCJ was applied.

No letter was ever received on the claim.

Thanks

Good Evening All,

I was hoping someone could help me.

While away in Aug 2024, I received a notification on my credit score that a CCJ was applied to my file. When I enquired about it, it turned out it was for parking in a residential estate with a disable badge displayed from 2020 during covid.

I completed the N244 form and the case was held around Nov 2024, I tried to explain to the judge that I had not received any papers on the judgement as it was made in default. She even agreed that they company were out of line for waiting 4 years and even questions the interest added to the fine for £814 but still dismissed my claim saying that the paperwork was sent by the courts and I must have received it and I didn't have an legal grounds to get it set aside.

I have tried contacting the legal team of DCB legal to see if we can come to an agreement of having the CCJ removed for the condition of making the payment as I just wanted to be done with this. This emails were ignored. my job requires an enhanced security search and a CCJ could impact my next job due to the area of work am in.

On the 26th of February 2025 I heard a loud knock on the door I looked through the window and saw and enforcement officer. They knocked and knocked but left and didn't leave any paperwork. Over the weekend I received a letter see the attached stating that they have applied for Writ of Control and have added an additional £1k to the alleged money I owe.

I am so confused as I don't know how this can be legal.

I am completely overwhelmed and lost and I am having troubles sleeping and the stress of it all is beginning to take impact my health.

The total money allegedly owed is is over £1700. I don't even understand how they added an additional 1k to it.

I have made peace that my credit is complete messed up but as a matter of principle I see no incentive to pay and still have CCJ.

I am trying to understand what else they could do. Could they attached this to my earnings or bank account?

I know it's probably too late for any advice now but appreciate any insight.

Thanks
