Hi there, so I received this email from Dcd legal asking again for settlement and frightening me about CCJ
what should I do please . So basically we’ve gone from £170 to £60. Do I stand my ground hoping that they will drop this or do I pay the £60 to put an end to this? What are my chances of ignoring them?


Good Afternoon,
 
WITHOUT PREJUDICE SAVE AS TO COSTS
 
We write in respect to the above Claim and shall shortly be sending to you our Client's Witness Statement together with all documents in support of their Claim against you. This evidence will be presented at Trial, and we are confident that your liability for repayment of the Parking Charge will be determined by the Court.
 
Despite this, we have been instructed to attempt to settle the case with you so that the matter can be brought to an early conclusion and in order that you may avoid a County Court Judgment (CCJ) being granted against you, should the Court award this in our Client's favour.  They are therefore willing to settle the case at this stage for a reduced sum of £60.00. Should you be agreeable to the same, please ensure payment is made within 14 days of this email.
 
If payment in the above sum is not made within 14 days, we have instructions to proceed to Trial, where a CCJ could be granted against you. A CCJ can remain on your credit file for 6 years from the date it is granted, and its impact may make it difficult for you to obtain credit in the future, such as a mortgage.
 
Once paid we shall inform the Court of the early settlement, requesting the Trial be vacated and the Claim marked as paid. We shall then close our file.   
 
The benefits to you making a payment to settle the Claim at this stage are:
 
Avoid the case proceeding to Trial where you may have to attend.
Avoid the risk of a CCJ being granted against you and the impact this could have on your credit file.
Avoid the risk of further fees and costs being added to the amount you owe should the Claim proceed.

Thank you. That’s exactly what happened. I received today Notice of Transfer of Proceedings.
This said that the Claim has been transferred to the county court for allocation.
The judge’s decision will be sent to me in a notice of allocation.
So just have to wait.

Hi there, it’s been a while since I had the mediation session. Nothing has happened so far. Should I be expecting anything else at this stage? I just don’t want them to come back years later with this again.

Hi, just had the telephone mediation call and was offered to settle but as advised I just said I’m not prepared to settle. The caller then said if at any stage I decided to settle then I should contact the claimant.
She then emailed me this:

Although a settlement could not be reached on this occasion the parties are reminded that Court is considered a last resort and in which case both parties are encouraged to continue to communicate where possible in an attempt to resolve the claim, you may find that today’s mediation gives you both a base upon which to build on.

If the parties can satisfactorily resolve the matter without the need of the Court, the Claimant should complete a notice of discontinuance using the appropriate form in the link and file it with the appropriate Court; N279 - w3 Notice of discontinuance (6.99) (publishing.service.gov.uk) or update Online Civil Money Claims through your account.

If not already done so. the claim will now be transferred out of our business centre to a court where standard directions will be given and you will be notified in writing of the next stages to follow. It is important that both parties follow these instructions and adhere to the timetable set down by the Court which will include a further court fee and a final hearing for determination of the matter.

Morning, I just received date for telephone mediation. Any idea how to prepare for this?
Mediation is for 14/04/25
No other letter in the post yet just an email the tribunal service with a slot for telephone appointment.
Any advice please. Thanks

These are the two documents I received. I need to fill out the n180 form I think but I have no idea how. Would you like me to send all the pages of the notice? It’s about 5 pages document.

So in regards to this issue I now received 2 separate documents in the post this morning and I’m in panic mode. First document is from DCB LEGAL advising that their client intends to proceed with the claim.
The second document is a Notice of proposed allocation to small claims track. I don’t know what to do and where to start at this point.
Any advice is appreciated.

I received an acknowledgment of my defence from the Tribunal and a copy is being served to the claimant.

I have now sent the email with both defence and draft order in one file to the email with myself in copy.
